Draft POPLA appeal: any suggestions please?

Hi,

I received a NTK yesterday from Parking Eye for "Unauthorised Parking" in a caravan parking space at a service station on the M6. The car was parked for less than 10 minutes, long enough unfortunately for one of their vultures to swoop. There was no windscreen notice, and although their photos show a sign that says "Warning: Caravans Only", that was ALL it said - no mention of dire consequences to follow.

  • The incident occurred on October 7th, and I received the PCN yesterday, November 11th.

    IK thanks , PE don,t usually have bodies on the ground , and I noted you said that their was supposedly a ticket on the car , I was hoping that they would have contacted you within 14 days , sand put thier foot in it.

    forget that appeal , PE do not care about you or your dog , a photo of that sign might go down well at an appeal

    Was there clear signage stating that the area was reserved for caravans? The reason I ask is that there are similar problems with cars parking in coach only bays in service areas and while car drivers think that parking for a few minutes is ok, you have to ask where caravans, motor homes (or coaches) are supposed to park if cars occupy spaces which are clearly designed to accommodate larger vehicles.

    In my opinion (and it is just that, an opinion), providing there was clear signage I think the 'invoice' in this instance has been correctly issued.

    Sorry but I think a sign saying "Caravans Only" is sufficient to convey the conditions of parking in that area. Being a coach driver, it's a regular occurrence to find limited available coach bays at a motorway service area because a lot are occupied by cars. I'm sure caravan and motor home drivers have the same problems.

    Unfortunately we coach drivers cannot just park a 12 metre long coach into a car parking space and we are compelled to have a statutory break occasionally.

    I'm all for slating PPC's and their tactics but sometimes some drivers do park inconsiderately. Providing the signage is clear, I don't think an appeal will succeed.

    perhaps PE should have installed the CORRECT signage , something like "caravans only £100 for non caravans"

    why should you have to second guess signage?

    there was no signage to state that there was a £100/60 penalty for parking a car in that area

    You have now twice posted your opinion.

    This forum is not a forum for bus drivers to seize on posts to air their hobby horse.

    The op wants sound advice not I'll advised opinion.

    There is sound advice and a tried and tested proforma appeal in the newbies FAQ thread intended lo get. Popla code.

    Op ignore the coach driver's opinion and do follow the FAQ thread.

    I'm not disputing that the OP should appeal if the signage wasn't clear. The same applies to local authority PCNs, the signage must be clear to be enforceable.

    BUT, (to me anyway) if the signage simply says "Caravans Only" (or in my case, Coaches Only), is that not sufficient information to convey the message? Is it really necessary to have to include "God Forbid You If You Ignore This Sign" consequences?

    The 'restriction' is there for obvious reasons.
