UKPC help

My son who has Cerebral Palsy was attending an ESA appointment and his carer parked in a retail park car park as it was across the road from the building they were going to for the appointment and there was no parking available at the building they were going to.

She didn't park in a disabled space as the normal parking spaces were nearer to where they were going. The blue badge was in the car window but not open as it wasn't a disabled space.

Needless to say she got an invoice for £100 for leaving the site.

I just need some advice as to what to do next. Should I write to UIKPC explaining the situation and send them a copy of the appointment letter and hope they have a heart.

OR would you advise another route.

    Definitely. Read the NEWBIES sticky thread and follow its advice. PPCs don't have a heart, so your suggestion is laughable (no offence meant).

    If they had a heart or even any intention of actually managing car parking their tame Muppet would have advised you of the rules instead of allowing you to leave site.
    However that would affect his incentive bonus, and their potential profits, as that is what this is about.
    Follow ST's advice and forget any appeal to their benevolent side as there isn't one!

    As above, don't appeal using mitigation. What happened on the day won't get you anywhere.

    The vehicle keeper on the day (the carer) or the registered keeper should appeal this using the BPA template in blue you will find in the Sticky thread for NEWBIES. Copy and paste and send. Do not edit. Do not reveal who was driving.

    It is virtually impossible for a parking company to prove "left site" and as already mentioned, if they do then they have failed to mitigate their loss by not telling the motorist at the time.

    Think of it like this

    "Dear PPC

    The driver admits to contravening your t&c. She does have mitigating circumstances (which I know the independent appeals service can't consider). I also know that the penalty charges you impose are your only source of income and it is easiest to extract from people who roll over and admit they were at fault.

    Please let the driver off and lose your £100."

    Chances of success???
  • Ok, so I have copied and pasted the letter in blue.

    Should I attach a copy of the appointment and a copy of the blue badge?

    I received a reply to my letter today saying ....

    In order to make a final decision regarding your appeal, please can you provide evidence that you used the facilities on site to our Appeals Department within 14 days of the date of this letter.

    How should i respond to this?

    This is a new wheeze asking who was the driver

    "evidence that YOU used the facilities" ????

    If you have receipts from retailers you can copy those and reply back as the keeper ..... do not name a driver

    We don't have any receipts as it is a retail park ( furniture store, carpet shop and DIY shop) and she wandered around the furniture store whilst she waited for my son :(

    Just ignore it. If you look at every other UKPC thread here (and I hope you've read some) you will already know they try a waste-of-time 'fishing for details of what happened to try to flush out the ID of the driver' letter first, then even when you ignore their delaying tactics, they will in any case, eventually cough up a rejection letter & POPLA code.

    You will learn most by reading other UKPC threads, in readiness for POPLA. Search 'UKPC POPLA' and you will see most people have to ignore a daft fishing letter before they get to the winning stage. The nearer you get to day 56 without them remembering to serve a NTK, the closer you are to winning. That's how you will likely win 'no NTK = no keeper liability'.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
