From the notice on the pole I took the below:

    (b) having an interest the land, the enjoyment of which, or any interest in which, is because of the nearness of the land on or over which the apparatus has been installed, capable of being prejudiced by the apparatus.

I've read and re-read this paragraph several times now and it just doesn't make any sense to me - what on earth is 'having an interest the land' actually supposed to mean ?

It's a legal term. You can have a legal interest (you own the land), an equitable interest (land is owned by someone else but you have an interest through a trust), or a nonpossessary interest (a right over land that you do not own).

OP is claiming to have a nonpossessary interest, that they have the right to enjoy the view over that land without a pole in the way. He may get a goodwill payment from BT to shut him up, but I don't see any legal basis for such a claim.

Shouldn't there be an "in" between interest and the though.

    I didn't understand it either

OP I genuinely cant think of any telegraph pole affecting the value of any property. I know electricity poles can for obvious reasons, but that doesnt include telegraph poles (telegraph poles are not covered by compensation like electricity ones are). And even for electricity claims, the pylon needs to be on or over your land (as in have wires running over your land).

Sure it might potentially put someone off buying - as might your choice of decor or your neighbour allowing their home to fall into disrepair - but it doesn't actually affect the value of your property.
You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride

So this is all about compensation then.
Have to agree, the compensation culture again, don't like the pole but give me enough money and I will put up with it.

Why has the pole been erected and will you benefit from it in anyway?

from the little information posted i assume this is in an area that has had telephone service for many years so what is the purpose of the new pole

The grid system (with several hundred roundabouts) works perfectly. The only ones that get snarl ups are the ones where they have installed traffic lights in the last few years at a cost of millions.

Does screw with tyre wear though!
