  • Have you any known defences where it is believed that the PPC has either intentionally or unintentionally broken the BPA Code of Practice Version 7 - January 2018 Paragraph 9.5?

    I believe Minster Baywatch have and have followed that up by being evasive in their response to me queries.

    Most defences mention a breach of the CoP, because IMHO most PPCs do not play nicely.

    I was hoping there might be a template out there covering para. 9.5 of the code of Practice which I believe they have used misleading tactics and now also since I have read more, paragraph 22.12 regarding appeal rejection letters.

    I didn't realise any of this and got letter from cel saying they are claiming 320 pounds. I sent defence back saying I have received no other letters whatsoever regarding this and they can't just send me a letter out of nowhere regarding this. I think I have messed up. Now I have a dq to fill.

    would stopping whilst making deliveries be wise to mention on defence or no?

    obviously somewhere like city centre's where parking is difficult especially flats and the like

    Loading/unloading/delivering is not parking. Look up the Laura Johnson vs Homeguard Services case for more information, and quote it in your defence.

    Very wise to base a defence on that, yes, adducing Jopson v Homeguard (read the transcript now, Google it an find it in the ParkingPrankster's case law pages).

    You will see why it helps, and it's an appeal decision = persuasive to county court.
