Look's like I am another unwitting fool to fall foul of the ANPR cameras at Town Quay Southampton (ParkingEye)
Date of event 30/10/16
Amount due £100, 60 if early
34 minutes.
I am also reluctant to admit that it was for Pok!mon reasons... I have looked at similar threads, and my are there a lot of them. I can see the kind of things that I should be compiling, but feel that I have a mixture of points to prove.
1. There is a Pok!mon Gym (part of the game) located just beyond the ANPR cameras. So If you intend to pop in and battle (as me and my partner Ash often do), this may take longer than 15 minutes. I'll be honest- I had no idea that it was this kind of car park. It is always dark when I go down there, there are very few cars parked, and on this particular occasion it was raining.... I saw that it was pay and display, but moved around the car park. I am pretty sad that there is a gym located within a pay and display area. I get the feeling more will fall foul of this. Poor Ash and Misty!
This leads me to the next issue.
2. I think, but cannot quite remember that I may have made two visits to the area within the time period, i.e may have double dipped. There is a 'pokestop' outside of the ANPR area, and I believe I may have exited the car park, and re-entered. I am not sure, and don't know how to pursue this.
3. I understand that it is not 'relevant land' and may have a point to prove here
4. I did not understand the signs. If I had then I would not have gone beyond the ANPR cameras.
5. The invoice amount is disproportionate. The car was never left unattended.
I am poised ready to submit to ParkingEye, but find the mixture of advice hard to collate into the correct information to send to them!
I would also like to warn others about it. Especially those going to play a game! It might be wise to put signs up around there or get the gym moved. It is well advertised as a place to go, and I was taking part in a Halloween event which made more people go there! I guess more and more people will appear here soon! Would it be worth getting a press release or complain to the council/Pok!mon?

At this stage, follow the **NEWBIES** thread, send off the template appeal letter (which will be rejected), simply with the aim of getting the POPLA code, and then come back.0

It's the 'why' that I'm stuck on!0 -
It's the BPA template in 'blue' text for ParkingEye.
All the 'why' you need is in the letter, and is basically irrelevant because they'll reject the first appeal even if you had Obama, the PM, the Queen, the Pope and God Himself testifying it wasn't you.
If you feel like it, amend the template letter to **ONLY** include your stance that you believe this to be a double dip issue (and refer to appropriate cases), and the relevant land under POFA issue.
The other aspects you raise are irrelevant at best, and damning at worst.0 -

Post #3 of the NEWBIES thread has the POPLA template points you need - your job is to put them together and show us, to make sure you have not missed anything. You need to also add stuff about bylaws.
You could also search the forum for 'Town Quay POPLA' to find a few that have recently won since the Summer (don't read any older ones). You should then be confident of your appeal points.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Just recieved an email from POPLA after appealing-
"ParkingEye have told us they do not wish to contest the Appeal. This means that your appeal is successful and you do not need to pay the parking charge".

Well done for taking that leap of faith and trusting our advice and researching other cases to achieve your success.
