What am i entitled to in a separation

Need advice please:
This is where i am at
I left my husband 4 1/2 years ago.
he lives in the house that is mortgage free.
He has paid me a small amount each month as a gesture for living there.
I had the house valued at 120 -130k though they said may sell for more.I asked him for 65k a straight split, and wouldnt want any of his pension or take anything from the house.
He has come back saying that he wont pay more than 50k as it is the value of the house when i left that counts minus all the work that needs doing on it.He also says i have to take into account the £150 a month he has paid me for the last 2 years as he shouldnt have been paying "rent" to live in his own house.
I feel this a bit unfair, does anyone know if he is correct?
ps there are no children involved.

There aren't hard and fast rules.
But the starting point is 50/50 and that includes the value of pensions.0 -
The house he lives in, was it owned by you both? Have you moved out to a property you both own or just you? IE is there just one property.
Is there a reason or hasn't been sold in nearly 5 years?
Where are you in divorce proceedings, I'm guessing no financial settlement had been broached with your solicitor?Forty and fabulous, well that's what my cards say....0 -
Assuming the house is equally owned.
The £150 a week seems irrelevant as you both have to pay for accommodation somewhere. I would be tempted to offer £65k again before letting the solicitors loose which will drag pensions and legal fees onto the table.
Either way find a solicitor that deals in divorce for advice and get some advice.0 -
Just go to a solicitor and do this properly. Get a full and final financial split that takes into account everything and end all ties with each other so that you can both move on.Don't listen to me, I'm no expert!0
