PCN Fistral Smart Parking

Hi All,

I am hoping you can advise me.

I have received a PCN for a visit to Fistral by Smart Parking.

We arrived spent a few minutes whilst I popped in to the Pizza place to see f there were any tables and hubbly looked for a parking space, there weren't any tables so we opted for Ricks fish & chips take away, I have a receipt.

Hubbly tried to call to pay the parking but couldn't get through whilst I got the take away, so we then left, spent just over 30 mins according to the CCTV pictures of us going in and out.

Do I have any grounds for appeal?
1. We did use the facilities
2. We did try to use the phone method to pay but O2 reception is so pants in Cornwall?
or should I write to the landowner explaining asking him to cancel ?

PCN issued 27.10.16 so 14 days for the reduced fee are up today.
Any advice greatly appreciated.

    Why haven't you simply submitted the template appeal in the NEWBIES PLEASE READ THESE FAQS FIRST' sticky thread? That's the first step, nothing about the driver or looking for 'grounds to appeal'.

    We can assist at POPLA stage but you need no help right now in appealing. The FAQS explain all and provide the appeal for BPA members. Please don't copy & paste it here asking 'is it this one'. Yes, it is!

    Ok, so even though I read the signs and tried to pay, I should use the BPA template as it is with nothing about being a genuine customer? as it seems to indicate in the template notes that I should include receipts.

    Yes you can certainly add receipts but don't say who was driving.

    Say 'the driver and passenger were genuine shoppers and as proof, here are the receipts from that day'.

    Is it worth me writing a complaint to the landowner as well ?

    I challenge this 'PCN' as keeper of the car and I will complain to the landowner about the matter if it is not cancelled, the driver and passenger were genuine shoppers and as proof I attache the receipt from that day.

    Yep but not 'attache' (typo).

    Always complain to the landowner as well, complaints get parking firms kicked out. They have already kicked out ParkingEye at Fistral.

    But really there is no panic, Smart Parking do not sue and can't hold a registered keeper liable (so do NOT say who was driving in any contact/complaint).
