PCN Fistral Beach - Smart Parking

Just received a lovely PCN from Smart Parking for overstaying at Fistral beach.
Admittedly we arrived at 11:00 (car park was pretty quiet) and took time getting ready before we purchased a ticket.

We bought a ticket at 11:30 for 2 hours and the car was pictured exiting at 13:30. Had I realised it was an entry/exit charging system I would have purchased the necessary ticket (or left earlier).

Is it worth me appealing? Has anyone else received a similar PCN and successfully appealed? I don't remember the signage making it particularly clear that it was entry/exit based charging (why not put a bloody barrier up like other places ie Saunton)?

Have only just started reading the thread (first PCN) so apologies if there are many posts covering this - playing catchup!

there are literally hundreds of similar cases on here and pepipoo forums for this site and for SMART parking, so yes, loads of them

they dont use barriers so they can catch people out, its all about the money , welcome to the club of enlightenment !! ;)

there is no difference to the tens of thousands of other ANPR controlled car parks in the country , like retail parks , supermarkets , fast food outlets , motorway service areas , hospitals , shops etc

read the NEWBIES sticky thread and appeal as keeper using the blue text BPA appeal, dont alter it , dont add to it

then await either cancellation or a popla code

Have you any idea how long an appeal takes? i go on holiday in 4 weeks and do not want to get caught out with stuff I need to respond to while we are away!

Submitting the template appeal takes you one minute flat. Copy & paste the one from the NEWBIES thread.

Time it (delay it) to 'day 27' from the date of Smart's PCN (ignore the 14 day discount) then any reply will arrive while you are away and will give you either cancellation of the PCN, or a POPLA code which lasts a whole month from then. You will be doing a POPLA appeal around Christmas, or it will have been cancelled due to them recognising the forum appeal from the NEWBIES thread.

    OK - thanks.

Do you mean date of the contravention or date on the PCN?

Days should be counted from the date of the 'contravention', with that day being day 0, the following day, day 1.

Repeat, from the date of Smart's PCN. It tells you that you have 28 days to appeal.

  • Ha - sorry was being thick! I did re-read after I had replied and thought 'd*ckhead' - was too late though - I had already commented and I had to own my stupidity! Please feel free to ridicule - I am not normally this thick!

I do have proof from my bank account that I spent money (booked surfboard) - is it worth uploading this or just stick with the letter?

Attach that as well but do not write 'I'.

You are appealing as the keeper. The driver is mentioned in the third person.
