2x NIP issued for speeding in same week (park viaduct, luton)

Hi,

I have received TWO Notice of Intended Prosecution for speeding on the same street in the same week ! :-(

Alleged Offense:
Speeding - exceed 30 mph on restricted road - manned equipment Contrary to sections 81 and 89 of the road traffic regulation act 1984 and schedule 2 to the road traffic offenders act 1988.


1. speed offense 45mph
2. speed offense 41 mph

both in a 30mph zone (it is a dual carriage way).

I don't believe I was speeding - I drive a large people carrier, which sadly was recently involved in an accident. The car has been repaired but it could be that the speedometer is off ? I have proof of the recent car accident (through insurance) - is this an avenue worth exploring ?
And what is the buffer in a 30mph ?

  • a) if the car has been repaired, then the speedo should be accurate. If the speedo isn't accurate, then that's almost certainly a more serious offence than the speeding ticket.

    b) wrong forum I'm afraid - only parking "charges" from private parking companies here. Try Pepipoo.

    Having a faulty speedo is an offence. I really wouldn't want to use that as a defence. It also doesn't alter the fact you were speeding so you could land yourself deeper in the muck.

    If you haven't done one you should get a speed awareness course for one of the offences. That's no points. The other will carry 3 points and £100 fine if you take up the offer of a fixed penalty.

    Assuming no previous that's not the end of the world and shouldn't really affect future insurance premiums.

    It looks to be a mobile speed camera, no obvious warning signs are in sight and its actually a dual carriage way which leads on to a, what appears a reduced speed area.
    Lots of people are appearing to be caught out over the recent few weeks.

    Not sure if that really helps the cause.

    No warning signs are needed.

    Plenty of dual carriageways are 30mph and enforcement would start from 35mph - what limit did you think you were in and why ?

    Well at the time TBH I didn't really think 'oh its 30 mph zone, or 40 or 50'...but looking back, it is a dual carriage way .. the area was restricted to 30mph some years ago, there's text messages going around it our area about this..its gathering momentum as many people seem to have been 'caught out' going over 30 by the sneaky mobile speed camera van....mmm

    Speed limit has been in place for several years - surely time to get used to it. It's hardly sneaky to start enforcing the limit at this point. Or do you think that you should be allowed to speed until you are given a warning that it is going to be checked? My sympathy factor is zero - you knew the speed limit, just chose to break it as you presumably have been doing ever since it was changed.

    That's why they are doing it then, a piece of road where people ignore the speed limit.

    From the 2008 Luton Borough Council speed limit review:

    Although the route from Park Viaduct to Dunstable
    Road’s junction of Telford Way is a dual
    carriageway the fact that it has a poor accident
    record and has numerous junctions this speed limit is
    felt to be appropriate.
  • Its only sneaky when you're caught.
