    Marktheshark, I am certain henrik777 would understand and he's playing with you IMHO! He's a very established & knowledgeable poster on other parking forums.

    You are both on the same side, just with different opinions on whether to seal a bundle with red ribbon/string a la dark ages, or not...doesn't really matter, let's all stick together in this fight.

    Sounds more like FMOTL.

    Judges have certain discretion for many things including relief from sanctions but any judge who allows a trial to proceed with evidence dumped on a defendant on the morning of trial is, without doubt, not using their discretion correctly. (bearing in mind if you don't complain then that is your own fault although the court copies were probably late too)

    A nice tidy bundle is certainly helpful and some judges would appreciate it but the content is far more important, as is knowing the content and WHY it's there in the first place. Sealed is, to me, nonsense and will remain so until someone can show me otherwise. Of course if you do it, then it doesn't matter, but refusing to take paperwork because your bundle is sealed .....
  • In 10+ years of court practice I have never lodged trial bundles with ribbon! Always with sequential pagination, but worry about the content of the bundle not what you think lawyers do.... Oh, and sorry to disappoint but you'll need to visit an auctioneer to find someone using a gavel :)

    May I join the pink ribbon debate (in practise for 24 years)?

    Pink ribbons were traditionally used to tie up the papers and instructions being sent to Counsel. Green ribbon was used to sew up court documents, which were "sealed" with red molten wax. (The wax is the seal, not the ribbon btw, as is the court "seal" which many moons ago used to be wax, later became an imprinted stamp, and is now just a plain black ink pad-type stamp).

    The ribbon emanated from the olden days when we didn't have convenient things like lever arch files and staplers - the documents needed to be kept together somehow.

    When I trained in the early 90s the green ribbon had become outmoded and had almost disappeared. We were using lovely things like lever arches and staplers and treasury tags. The pink ribbon thing carried on for a bit. We used to tie up the lever arch files we were sending to Counsel, but not the ones we sent to court.

    I have litigated for 24 years now. I have never come across the concept of a "sealed bundle". The ribbon or tape doesn't stop an opponent attempting to dump new documents on you. You then tell the judge and say these should be disallowed. Many judges think it is in the interests of justice for all the evidence to be considered. Depending on its volume, you then say you need time to consider the new documents and the case should be adjourned with costs against the other side.

    If you have found something else on google I think it has emanated from someone with inferior knowledge. I stand to be corrected though.

    Please don't brush me off with a "you wouldn't understand". Believe me, me and henrik will understand.

    Don't worry people. I've decided to swallow my bundle the day before and visit the toilet just before the hearing to retrieve it.

    They won't get one over on me.

    Update: I submitted my WS and bundle to the court by the deadline of 28th March. I received nothing back.

    As it's been a week, I just phoned the court who have confirmed that Gladstone's haven't sent anything in to the court.

    I've emailed the court to complain that Gladstone's haven't complied with the orders of the district judge.

    Not sure what else i can do?

    Have a beer, then check back at the end of the week as court admin is, err, not very good.
