Claim form

I initially received a parking fine in November 2014 from Excel parking which I ignored and I have ignored all letters since as I was informed that this company can't legally fine me. However, I have now received a claim form from the county court asking for a total of £243.20. And now I'm panicking that I have to go to court. I'm assuming I can't go on ignoring this. Please could I have advice on how to proceed.

    no private company can "fine" you

    but they can "invoice" you and that is what they did back in 2014

    they also have up to 6 years to issue a court case using MCOL for non-payment of the "invoice" - so this is what they have done , via the Northampton MCOL bulk centre

    now please read the NEWBIES sticky thread , court section, and the links like the "bargepole" thread which tell you more about it

    then use the search box to find similar 2016 claims for EXCEL, typically the ones for the Peel Centre , Stockport, and prepare a defence after acknowledging online

    Do not panic, the County Court is not the least bit frightening. You all sit round a table, a judge weighs up both side's narratives, and comes to a decision. No wigs, no gowns, no shouty drama queens, not even a flag.

    This firm is being investigated by the SRA, and it looks as though they are trying it on with you, they can only charge legal fees once they have won in court. Report them to the SRA for fraud

    how is that £243 made up?

    if this got to court and you lost , I dout if there would be £243 to pay

    We assume by now you've searched the forum for 'BW Legal' if it was via them, and found the hundreds of threads like yours, showing defence wording. Umpteen cases recently with court claims.

    When you read the stiky threads at the top before you posted: 'NEWBIES PLEASE READ THESE FAQS FIRST' you may have missed the part headed up 'Small Claim?' so go and read that advice and links too.
