Paypal and Intrum Justitia.

Hi
Can anyone offer any advice? I've searched on the subject but I can't find the same scenario anywhere.

A few months ago I sold an item on ebay and shipped to the States, total value just less than £40. I have proof of postage and customs certificate showing addressee. (sadly it's not trackable)

The guy then either didn't receive, or said he didn't receive the item and managed to get his money back putting my paypal account £40 in the red, which I then walked away from.

Now Intrum Justitia have sent a letter saying they have started "formal debt recovery action" and invite me to pay up.
With my documentation proving I did post the item is it worth digging in the heels, or should I pay to stop the hassle and protect my credit rating?

Thanks for any help guys.

I think that paypal seller protection states that the item must be trackable in order for you to have a defence.

May be worth a try appealing with what information you have but I dont hold out much hope.

    Good luck!

    Hi Roony,

I'm following the procedure / letters set out here:
    http://forums.moneysavingexpert.com/showthread.html?t=598755

I've sent the first letter basically asking them for a copy of my signed credit agreement with paypal.

If they don't provide a copy of signed credit agreement then I'll send the 2nd letter.

This thread also has a lot of advice as to what letters to post:
    http://forums.moneysavingexpert.com/showthread.html?t=573294

I've had a reply from IJ - saying I signed up to paypals terms and conditions, and if I want to dispute this, then a complaint needs to be raised with paypal. (I've already done this, paypal don't care). IJ have asked for full details of the dispute in order to resolve the matter.

They have apparently returned my postal order (for £1), however, the letter contained nothing, and was opened, and resealed with sellotape!!!!

I may just send the 2nd letter anyway, as I still am disputing the debt, and "I acknowledge NO debt to them, or to any company they claim to represent"

In my case it appears to be blatant theft of the money out of my account to the tune of £700+ - they (paypal) say they returned it back to the buyers paypal account, even though I know for a fact that the buyers account was closed.

PS - you are best phoning paypal, as they simply 100% ignore ALL my emails to them.

    Have a nice day. :)

If you don't have a tracking number, pay up.
You agreed to PayPal T&Cs when you created a PayPal account. Even if you disagree, do you really want to pursue this for £40?
You will get more help on the Ebay community forums, there are people there who know this stuff inside out.
    Good luck!

I sold on ebay for 7 years without one single item going "missing". I notice on the ebay forums that sellers have items going missing on a regular basis.

It would seem that my insisting on cheque or PO only worked. Not knocking paypal as it gives buyers some protection but it does give certain individuals scope to work the system.

Have you tried the ebay forums for advice? They can be a bit sarky but they know the way things are with paypal.

    Good Luck.

this happened to me, someone hacked another person's account and bought something worth £90 off me, the owner of the account found out and complained and claimed the money back from paypal rightly so as it was fraud however paypal took the money from me to pay the other person back which annoyed me because it was there security issue that allowed it to happen wasnt my fault in the slightest, the J.I people rang me up a few months later and asked for the money, after a quick bit of research to find out how real they were we rang back and paid them the money for the sake of just stopping it cos it scared me. I thought that was the end of t but about 2 weeks later my paypal balance was then plus £80 which took me by surprise, paypal refunded me the money! Ive had confirmation the money is mine to spend but couldn't get them to admit it was there error unfortunately.
