How to avoid 50/50 car Insurers settlement?

Ok Here comes the $64000 question,
For example how can liability be determined if there is no cctv or witnesses at a road traffic accident scene?
When insurers tell their customers not to admit liability at the scene then how can liability be determined given the no proof circumstances above?0 -
If there are opposing stories without any witnesses etc you end up with split liability.0

The credibility of the drivers stories, were it to go to court.

Areas and nature of damage to each car.
For what its worth, I don't see how someone could undertake you if you were making a left turn there.0 -

Exactly undertaking successfully is impossible given the narrow lane space unless you want to collide with the car you plan to undertake.0 -
OP there is something your not telling us??? it doesn't sound right
Be glad your not 100% culpable. It's your word against his, so 50/50 is a good outcome."It is prudent when shopping for something important, not to limit yourself to Pound land/Estate Agents"

As explained earlier Glover Street is a tight left turn. If the driver was to delay his left turn because it is a tight left then that gives the 3rd party driver dangerously space to undertake by using the side street as space.
Making sense now for you?0 -
I think there's no point continuing talking further and looks like CCTV will have to do. Thanks everyone for their participation in this thread.0
