Inheritance abroad

In Italy, the law is very complex. My mother inherited my fathers ancestoral home, Succession is a legal requirement to pass down assets, whether a will has been left or not. As soon as one of the successors passes away, the next of kin become forced heirs and responsible for all debts and payment of bills etc. I have been working closely with a lawyer who specialise in cross border succession, which must be completed within a year of the deceased. I have since learnt that you can decline the sucession, however this is more complicated to achieve. The system is there to ensure that all assets go to rightful heirs. Hope that explains a little.
Noted and thanks. It sounds as bad as the French system that has impoverished agriculture because of breaking up small farms into ever smaller units.
  • While it has taken a lot to get my head around, it has been an absolute nightmare. You would think it is a privilege and a joy to have a property in somewhere as beautiful as Italy, sadly it is the biggest bureaucratic burdeon i have the misfortune to have. I fear now for my family because if we cannot sell the sucession will pass onto my kids. It is a very difficult thing knowing it is part of our histpry, but who wants to pay tax and bills on a home we will never visit again.....

Noted. A crazy situation. Put it up for auction with no reserve then. You would be well rid of it. I have an native Italian friend who emigrated from Italy because she was fed up with the widespread corruption and bureaucracy. I don't blame her!
