Council Parking Ticket on Private Land

Hi,
I was hoping someone could give me a bit of advice... I live in a block of flats on a private road (I know it's private because I have to pay towards the maintenance of it). Recently my building was damaged in a storm and part of the car park had to be cordoned off while repair work was carried out. One night after work I wasn't able to park so I parked about half a mile away from my home and walked. In the morning I needed to load my car and the car park was still full so I pulled up on the yellow lines went to my flat and by the time I got back to my car (about 10 minutes later) I had received a council parking ticket.
I didn't know that the council could issue parking tickets on private land but when I appealed I was told that the road had been adopted by public highways and that the council had the right to issue tickets on the road. We employ a private parking company to ensure that people who don't live in the area are ticketed for parking. It seems unreasonable that the council should be benefiting from a road that I have to pay to maintain.
I have explained the situation to the council but they have been unsympathetic. Is it worth continuing with my appeal or should I just pay?

You need to discuss with the council and the property owners of the flats who owns the land.
Is it possible you pay so people don't park in the car park which is private and not the road itself.
Also if there are double yellow lines, this suggests the council does maintain the road and you would be liable for any fine.
In any case you need to identify what exactly you pay for check rental agreement or deeds of you own.0 -
Check the extent of highway. Many Councils now have this online. If it is adopted highway check for a valid Traffic Regulation Order, some yellow lines are as a deterrent and aren't backed by a TRO.
If private land the TRO won't cover the land in question.0 -
You might be better off asking for this to be moved to or reposting in Parking tickets, fines and parking sub-forum as there are many knowledgeable people who populate that forum and can give you sound advice.0

After writing this post I emailed the council to find out the status of my road. They replied and said that my street is private land and not adopted by highways. Do the council have the right to issue a ticket on a private road?
The ticket is a council penalty charge notice. I reread the ticket and it states that "the ticket was issued due to being parked in a restricted street during prescibed hours." It doesn't mention anything about the double yellow lines.
Should I appeal again?0 -
Best place for real council tickets is Pepipoo forums. Your ticket might be a bit of a strange one for the Parking board here to work through.0

Just what I was thinking, sounds like Camden making up new rules again!
Why has no-one on this thread yet pointed out to the OP that loading on DYL is an exemption for a Penalty Charge? Maybe because it started on the wrong forum.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
