Incorrect default part 2

Hi all,

I am wanting to know how best to proceed with this issue. I have a debt that defaulted twice (as you will already know). I have just got my current credit report from Equifax and this debt is still showing, despite the original debt defaulting over 6 years ago, and Northern Rock agreeing that it should not have been defaulted twice. It seems that they have not told the DCA, as they havent bothered to tell Equifax (and I suspect the others) that they have the wrong date, and that it should now be removed.

I have a letter from Northern Rock confirming that the debt was incorrectly defaulted. Should I write to the DCA and include a copy of this letter?

Is there a template / does anyone have an example of a letter that I could send please? I am looking at getting a mortgage soon and this is now going to start harming my chance of getting one.

    Hi,

    It's a simple enough job to put together a letter about this.

    Include a copy of the Northern rock letter too.

    Send to all 3 CRA's just to be sure.

    I would also complain to the ICO as well (information commissionaires office).

  • How does this sound? This is to Cabot who are the DCA.

    Dear sirs,

    With reference to the above account, I am writing to complain information that you are reporting to the 3 CRA's is incorrect. You are reporting the default date of this account as 12/02/2012 when in fact the default date was 04/10/2010. I enclose a letter from Northern Rock (who passed the debt to you to recover) confirming the default date.

    Please correct this with the CRA's ASAP.

    I have also written to the 3 CRA's and reported this incident to the ICO.

  • Quick question. When I wrote to the 3 CRA's, did I need to give any specific information other than my name and address? As I do not have accounts with them (I do not want to pay to view my credit file), I do not know if they have me listed with any kind of reference number.

  • We have closure.

    I received a letter from Cabot today upholding my complaint. I am now default free! They have also admitted that as of March 2016 that my debt is unenforceable, and that they will not attempt to collect until they can comply with the cca (I made a cca request).

    So basically I guess I have 6 years from now to wait until it becomes statute barred if I do not acknowledge it?

    yeah, as you admitted the debt in writing, the six year clock will reset, however, the chances are Cabot won't be able to supply sufficient proof of the debt, so keep your fingers crossed. Cabot are chancers and will probably try and collect from you through the six year period (by sending various letters) but can't really take further action. They will probably try and sell it to someone else knowing them, so keep your paper work handy and try not to admit to the debt any further, just demand paperwork should anyone else try and get involved.
