Pcn..taken wrong action?

Hi, I'm aware there are a number of threads regarding pcn's and I have read the sticky threads too but I just wanted to check if I've made a mistake by ignoring mine..I received a pcn after going over the time in a private car park. The letter I first received from the company was vague and only showed my number plate no evidence of my car description or anything else. I chose to ignore this and have ignored all letters since. I've received a letter today from bw legal stating final notice and continuing to threaten court. I've just had a panic that I should have appealed the notice but when I've had previous charges (previously lived somewhere where they issued them a lot) I was told to ignore them...was this the wrong advice?
Any pointers would be great
Thanks.

you probably should have appealed it to Excel (or VCS) at the time, and possibly taken it to popla (depending on the date of the pcn) , or ignored after appealing to the ppc

too late for all that so all you do now is stop ignoring BW LEGAL , type their name into the forum search box and follow the same advice as given to dozens of other members about the same issues

ie:- you write back to BW LEGAL using the same words as the others and refuting the claim. this may (or may not) prevent court action by the PPC

    Any pointers would be great

There are well over a hundred pointers if you search 'BW Legal Final Notice' on this board. These letter have been done to death on this forum for 4 or 5 months. Everything already advised and example replies, are your pointers - go on do the search, then you will see!

If they issue court papers, come back and search 'BW Legal defence'. We've not lost one and on the basis of the lack of coherent evidence BW Legal are producing, I would be amazed if we do. They are doing a worse job then parking firms used to do on their own with the odd court claim, but it's a numbers game. BW Legal have not bothered to gather evidence, you are one of thousands of robo-claim targets which reap rewards for parking firms because so many people get scared & pay.

Do not panic and DO NOT pay.

A small claim is no risk at all, no CCJ as long as you defend and no huge costs (if you lost you'd pay about £160 so no different and very unlikely). You are likely to win with our help, as we've seen it all and done this before.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

To answer your question "Have I taken the wrong action?", actually you took no action! That is wrong as you have missed the chance of an internal appeal with the PPC and an appeal to the IAS/POPLA.

Now an appeal to the PPC or IAS is likely to fail miserably whatever you write, but an appeal to POPLA for BPA members has a better success rate.

You now have to grin and bear it until you get any court papers from Northampton. Take a tip - don't ignore them.

Spend the meantime reading up on here about formulating a defence and, should you move home in the next 6 years, have your mail redirected for that period. The PPC can take you to court anytime in the 6 years and if the court papers go to your old address, then you could get a CCJ by default.
