    It is a requirement to give them a chance to rectify the fault, this is a basic right that the supplier has the same as you have the right to a remedy.


    Having the car towed back is a consequential loss that is covered, but the garage had the right to do this on your behalf. Only when you have given them the chance and they have failed would you make a claim.

    Thanks for clarifying :) at least I know if it ever happens again. Bit annoyed that I was told otherwise by Santander, at least they will probably have that call recorded so they can make sure whoever said it is corrected.

    It would be worthwhile to make a formal complaint about the disastrous misinformation they gave you. Had you been correctly informed you would have contacted the garage, and then your Section 75 claim would probably have been successful.
  • An update in case anybody is searching for similar help - on review of the claim Santander changed their mind and the claim was successful.
