I received a letter in the post from Debt Recovery Plus saying that I haven't payed a parking fine and now it has gone up to £150!
First of all I hadn't received any letter prior to that as the parking charge notice was on 10/08/16 and the first I received anything from any parking fine is this letter which i received on 28/10/16.
It was my brother who was driving and said he didn't overstay the time. As it was busy it took a while to get a parking space etc so the actual time that was spent parking was less than the 3 hours they give.
This parking charge was given in the M4 Urban exchange parking.
I read the newbie post and that talks about the whole process.
Since i have only received this letter as a first do you guys advise just to ignore it or try and get it sorted?
I don't want to contact either the parking company (who have sent me zero letters) or the debt collectors as I've heard it is better not to phone them.

Because it seems like if i had received the initial parking charge I could have appealed it and won as many have done with the same car park.
However since this is the only correspondence i have received then I thought the circumstances may be different as I have not really had the opportunity to appeal.0 -
so send highview the bpa blue template letter from the NEWBIES sticky thread
but expect it to be rejected as being too late and with DRP
and as stated IGNORE drp (and any other debt collector letters)
Highview have 6 years to try a court claim
and try a landowner complaint, if they cancel it , thats the end of it , but get it in writing and keep all paperwork for 6 years0 -
Yes - DRP can't and won't do anything other than try to scam money out of you and it is highly unlikely that Highview will be interested in any retrospective appeal unless you identify your brother as the driver and try to force them back to back to square one to let him do a POPLA challenge.
However, Highview don't do court, so its probably a complete waste of time compared to sitting it out.
So beyond that, your only other options are to complain strongly to the landowner who can get things cancelled at any change in the process.0 -

You can complain to the landowner and you can if you wish, send an appeal from the registered keeper late, worded something like this (do not bother with DRPlus). This may be enough for Highview to give up bothering you:
Dear Highview,
Parking Charge Notice [0123456789]: Vehicle Registration [AA11ABC]
I refer to the letter you must have asked Debt Recovery Plus to send to me as registered keeper, dated xx/xx/16.
I will not be responding to a debt collector and take formal note: I did not consent to Highview sharing my data with any third party. Cease processing my data immediately for the following reasons (this includes your agents):
First of all, the first I received anything from you or your agents about any parking 'charge' is this letter, on 28/10/16. No Notice to Keeper was served at all and even if one is produced by you suggesting it was posted, I am fully aware that you do not use the POFA so cannot hold me liable.
I was not the driver. I will not be naming that person. It is a fact that you have failed to establish keeper liability. You will no doubt be familiar with the strict requirements of Schedule 4 of POFA to be followed in order for a parking operator to be able to invoke keeper liability for a Parking Charge.
So, to continue to process my data now that you have exhausted your only DVLA-allowed purpose (i.e. to invite me to name the driver, which I decline outright) would be wholly unreasonable and contrary to the Data Protection principles. To share, sell, store or process my data at all now you are aware that you have no further excuse or reasonable cause, will be data misuse and I will report you to the Information Commissioner.
I deny liability for any sum at all and you should consider this letter a Section 10 Notice under the DPA. You are required to respond within 21 days.

Add to the end of C-Ms letter that, now they have been notified, if they continue to hold or use your data in any way and do not issue an immediate cancellation which also confirms that your personal data has been deleted, you will be filing a claim for compensation for data misuse as per here: http://parking-prankster.blogspot.co.uk/2016/11/smart-parking-settle-out-of-court-for.html0
