Riverside retail park Chelmsford

A few years ago my partner got a ticket here, I followed the stickies and made a POPLA appeal and won. Recently her friend has got a ticket, I understand the Beavis case has changed things here possibly?

Or is this all futile?

Asking managers etc is no good as she lives 3+ hours away.

    Very difficult at this location unless circumstances are wholly different. But there's no cost in attempting an initial appeal (from the newbies FAQ sticky) or a subsequent POPLA appeal. You never know, PE's automated system may just muck up on deadlines, or even arguments. Go through the motions, short of a court case - unless very switched on and prepared for a big defence.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    Appeal might well be futile unless:

    - she has receipts totalling over £30 - include copies in the appeal to PE online. We know PE do cancel some 'genuine customer' ones.

    or

    - the PCN is a 'blank space at the bottom' one which does not mention '29 days...keeper liability'. Ask the friend to compare it to this:

    Alongside that, get the friend to go and speak to EVERY Store Manager there, receipt or not, and find the one who WILL cancel it. The Matalan Store Manager used to cancel them a lot IIRC, and try Staples seeing as it was their fault that Mr Beavis was delayed. They (presumably) do know what they've done to consumers? Then try all other Store Managers (not Chantelle from the tills or Beryl who is covering the CS desk!).

    Unfortunately the PCN does not have blank space, and going back to the retail park will be difficult.

    OK but if they have proof of patronage than PE do cancel in most cases. So make sure an appeal is lodged in time, attaching proof of spending (preferably over £30 to give them a fighting chance).
