I can't seem to find my original thread but in short ....
In February 2011 I had a parking ticket issued for over staying at an excel car park. Dozens of threatening letters followed. The advice back then was to ignore which I did.
I heard nothing for years until the last few months. First I was receiving mobile phone calls and now several letters from bw legal requesting payment.
The latest letter came today saying if I don't pay by 14 Nov they will take me to court and I will have a ccj.
Any advice? Can they continue to harass me nearly 6 years on?

This was your first post in 2011 concerning this subject. It was on someone else's thread, not one you started yourself. Post 128.I had a ticket on 25th Feb from Excel for staying in a carpark for over 2 hours. I have read some posts but haven't had the time to read them all.
So am I right in saying I shouldn't be paying this. I remember hearing something about illegal clamping by these sort of companies but are the tickets illegal too?

Re the SRA complaint it is done online, not by letter - wait till you have some misleading stuff back from BW Legal first, do not rush this.
You want to string this out till gone February. Hence why you just ask for photos and deny liability and ask how a pre-POFA PCN can hold a keeper liable, prior to 'keeper liability'.
Slowly does it, wait for their response then reply again. Then pick your moment to make the SRA complaint before December, like the one shown on LoveNorfolk's thread.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I have received your Letter Before Claim dated 1st September 2016.
I deny any debt to Park Direct UK Ltd
The driver is not identified in your letter and your client has failed to meet the requirements of The Protection of Freedoms Act to pursue me as keeper.
You also cannot presume that I possess all the documents referred to in your letter.
Please send me copies of all the documents sent by the client including the windscreen notice if one was attached to the vehicle.
When these are supplied, please also confirm whether the intended action is founded on a contractual charge, a breach of a contract or trespass
Please confirm that your client's contract with the land-holder includes specific authority to take legal action and that this will be produced for the court.
I also require an explanation for the additional £50 charge including confirmation that it has already been invoiced and paid.
When I receive the documents and your explanations I will be in a position to make a more detailed response
It would be unreasonable to proceed with litigation before you have clarified your client's cause of action.

I reckon you should also add something about the fact it's a pre-POFA PCN, incapable of holding a keeper liable and ask them to explain how they believe there are grounds to pursue a keeper, out of the blue, five and a half years later.

Loads of choices, loads of good letters and examples of dragging it out with letter/email tennis and a SRA complaint to keep them busy until the six year limitation to pursue it is up.

I just cannot wait for one of these pre POFA cases to get to court, I hope the appellant can fight their corner. Or perhaps one will never get to court.
I realise that academically, most solicitors are not top drawer, but surely they cannot be that stupid. ymeaYou never know how far you can go until you go too far.0
