    Benefit to others or not; if she left stuff behind the landlord is fully entitled to claim costs of storing/disposing of it.

    Our last house occupiers left behind a load of junk they 'thought we might like' in the loft. Took me ages getting everything down and even longer convincing them to come and collect it before I went through the solicitor.

    You cannt just leave things behind and assume they will be wanted/useful. Tenant should check: "I don't want my dishwasher - would you like it, free, or shall I dump it when I leave?" If landlord writes back "Leave t." then fine. If not, and tenant leaves it anyway, LL can charge disposal cost (after checking tenant does not want it."

    Cleaning is a simple matter of comparing condiion recorded on inventory against condiion at check-out.

    Big difference though with that, I remember one of my landlords complaining I left a 3 week old microwave that had been used only a few times when I moved to another property of theirs that already had one, shame though as the one in the new property was rusted to the point it sparked when used.

    And I spoke to the person who moved into my property after me (the very next day) and found out one of the reasons they took property was it had a microwave! (and thinking about it they must of allowed viewings without telling me to get someone that fast)

    My LL still claimed they had "cleaning costs" though after I moved my stuff out I spent hours on hands and knees shampooing carpet, using cleaning products on the sealant around bath etc.

    Also my LL didn't care that the property I moved in had human bodily waste of multiple types over walls and floors and stank and I spent 3 days cleaning, reason being they said they had to pay to clean my old property so I was making up for that (I dont think wiping down human waste from walls is the same as their idea of a mess in previous place)

    They picked a property because it had a microwave? Really? Something worth less than £100. I very much doubt it!

    Yes, I'd agree; as an update my SIL has written to the Landlord, explaining the situation (in considerable detail)


    He has agreed to refund the deposit less £100, so a pretty good result for all concerned I think.

    A very good result for the landlord...

    From what you said, he does not have the documentation to support a claim to the DPS and so had your SIL stuck to her guns the entire deposit would have been refunded. Furthermore, since he did not do what was legally required (give her details of the DPS within 30 days) he was liable to pay her a penalty of up to three times the amount of the deposit. So he has got off very lightly indeed.

    Yes, because a microwave would be an added expense and in the terms if they had two properties that were a close call you would go for the one with more, so the microwave tipped the favour so yes they took it because of the microwave.

    And they were on benefits so couldn't afford a new one themselves.

    As they say money doesn't grow on trees.

    You could say that, as for one I have only lived in small town areas for the most part, never had a landlord ask for a reference, none do credit checks which would mean they themselves werent the best.
