hi all
received a letter through the post yesterday (well from the mother in laws where the car used to be registered to. the address has been changed well before the mention incident). this letter is from debt recovery plus demanding £160 for a parking charge notice
this is the first time ive heard of any parking charge notice for that day. nothing from smart parking or anyone. ill admit that i did drive into the car park on that day and time and went to the shop to ask for directions and while i was gone the missus was sorting our 10week olds bottle and nappy out etc so i was in the car park for about 10 - 15mins.
spoke to DRP ltd and they dont want to help. they said and i quote "the easiest way to sort it is just to pay now" told them in no uncertain terms thats not going to happen anytime soon.
rang smart parking "weve passed the case onto Debt recovery because you didnt respond to our first letter".......which as above i didnt receive.
Spoke to citizens advice bureau who said to go to smart parkings website and appeal. so ive done that but not holding my hopes up.
apart from the next step being taking the case into popla what would you all suggest doing?
tia

You're past the point of getting this cancelled. But - no need to pay!
Instead you can now make Smart Parking pay you. Please read this hot-off-the-Press case reported by the Parking Prankster just yesterday for a Fistral Beach case. This is very do-able and well within your capabilities.
While this person settled for £275, the advised compensation is rated at £750. Go for it, make them pay for their folly in trying to gouge money from you.
http://parking-prankster.blogspot.co.uk/2016/11/smart-parking-settle-out-of-court-for.htmlPlease note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

You won't get POPLA as the appeal will be deemed late, so just ignore the debt collectors. NEVER ring them again, read this thread:apart from the next step being taking the case into popla what would you all suggest doing?

Relax, Smart are tame and it will just be a matter of collecting and laughing at threatograms unless you do get a POPLA code, which I doubt. No problem!
