Thomas Cook - under ocupancy charge mis informed

Hi
I booked a holiday for my family through co op travel for a Thomas cook holiday in July next year. We have used co op travel several times before with no problems so assumed this would be the same. Last week I was going through paperwork etc and noticed a £800 under occupancy charge! I went into store to challenge this as this was NEVER mentioned i would never agree to pay £800 for nothing. I admit i should of checked the paperwork sooner but when the holiday breakdown was explained this was not mentioned.
I have since tried for weeks to get contact details for their head office after great difficulty i managed to get a manger in Bristol. I have asked for a refund of deposit but i have been advised they will not cancel or refund me but have offered to change the holiday with no admin fee. Problem being as we can only travel in peak holiday time the prices have now gone up.
Any advise would be great...
Thanks x

So is the total price £800 more than you agreed to pay?
Or is it just that you've discovered part of the price you agreed to pay is for a reason you object to?Everything will be alright in the end so, if it’s not yet alright, it means it’s not yet the endQuidquid Latine dictum sit altum videtur0 -

You're not paying £800 for nothing. You're paying it for under occupancy - ie having a room that could sleep more guests.0 -
Duplicate thread, OP has more replies and has given more info here:

In fairness to the OP, another poster did suggest this was more appropriate on here than 'Consumer Rights'.peachyprice wrote: »Duplicate thread, OP has more replies and has given more info here:

Some fair comments on the other thread.
OP - how much is the upgrade that has not been applied?Hayleymarie wrote: »I assumed the total price was inc a upgrade which has not ben applied - I admit I should of looked closer but when going to pay next amount of deposit seen £800 for under occupancy when there is 4 travelling in a 2 bedroom apartment.
The manager did not deny mis informing us.
Did the manager admit to misinforming you?0 -
I'm guessing you were happy with the overall price when you booked, or you wouldn't have booked. You aren't paying for nothing. You're paying to occupy an apartment that will occupy more people than you're putting in it. Putting 2 people in a 4 bed apartment will always incur under occupancy. The charges were broken down when you booked. Its part of the terms and conditions that you check your confirmation as soon as you receive it and notify immediately of any mistakes. Even though no mistake has been made you'd have been on a better footing than choosing not to bother checking, and then expecting them to cancel free of charge, even though the price is the same as you agreed to.0

You re paying £800 for having more space than you would have if 4 people were occupying.0
