I have been trying (and failing) to write my less than convincing defense following the arrivial of a cc claim form but after looking through days of other peoples case defenses i realize that i am on really thin ice having told Premier Park that i was driving.......doh! it would seem that only bad signage may be applicable.....
if i now pay the fine £150 to pp will i still have to go to court or will they call off the hounds (Gladstones)
so far i have acknowledged receipt of the cc claim form.(...said i will forward defense in 28 days). does this mean i can halt proceedings if i pay up......need to stop this thing consuming me totally....my kids need their mum back
thanks for reading,

the charge was a max of £100 , so why pay them £150 now ? if you went to court and had a day out , laughed at premier park and their expensive solisitors , and lost , it would cost you about £175 , happy in the knolage that it has cost them almost £300 to get £100 back!!!
if you offered to pay now they would just add extra fees here there and everywhere , and increase cost to £200+ with no outlay to themselves
take many small children and flasks , have a day out and let the kids have a laugh at the "Gladstone circus" ,Save a Rachael

oh how i wish i had your confidence...... but being of a rather nervous disposition anyway and not really having much of case however i spin it, i would be the one who gets a lashing in court from the legal beagle and a grumpy judge.......i have a read of the case where a lady gets hit with over £300 costs ... i feel her pain...i can think of more enjoyable ways to spend a day out with the kids!!......
you guys and girls are great and always manage to make me smile however stressed im feeling so thank you for keeping it real. keep up your exellent work.0 -
Gladstones are not hounds. We have NEVER lost a defence against them this year and not seen one even get past the starting blocks, no hearings happened. And you are not the first person to have said who was driving.
You do not just have 'dodgy signs'. You have all the stuff about no landowner authority and 'no contract or agreement on the charge' and not forgetting the debunking of the woeful Particulars of Claim which presumably were a couple of lines not even identifying the location or car?
Search 'Gladstones incoherent' and copy half the stuff you see, only removing the few points about 'POFA/keeper liability' that you can't use.
You need to show the courts that this claim is not properly pleaded with a lack of information about the contract and circumstances - mentioning the one struck out for being 'incoherent'. If you achieve that then there would be no hearing anyway.
You need to bump your old thread please, leave this cold feet thread to die off. Let's get back to your defence, show us by replying again to bring your thread back to the top of the pile for viewing again. I saw your defence and it was looking quite promising - I just had no time to reply due to a busy half term.
Shove it back to the top by replying again asking for comments there - and let this thread go.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

They might not even turn up, then you win by default. The judges aren't nasty and they understand that you are not a legal beagle yourself.
I filed my defence and sent it off and they dropped the case with about a week to go.0 -

Now that is what I call a very positive post
If "worried jim" (with a user name like that), can do it

I got all of my advice from this site ( and amusing anacdotes from the parking prankster), I was nervous but determined that these scammers wouldn't get a penny from me. As soon as they realised that I would be turning up to defend they knew that even if they won they would be out of pocket, cost of travel to the South Coast and to hire a solicitor, so they folded.
I suspect your case may be the same, although I understand that they do have to proceed occasionally to try to set an example and they can trumpet their result publicly (someone correct me if I'm wrong) on the slim occasion they win.
That's why it's important to submit a proper defence to let them know you mean business and are quite willing to see it through, never surrender etc. Good luck, you can do it! Jim.0
