Hello,
My partner recently bought a second hand car from car dealer, had it for 5 weeks now, suddenly something is up with the clutch, been in garage for two days now while they price up for repairs, anyone know any advice off dealing with this?, I may be wrong but I was of the thinking that the dealer will sort it due to not beinh so long since the purchase?, have we any rights? Any advice much appreciated thanks

Depends what's wrong with it. If it's a fault that was present at the time you bought the car then yes, the dealer will need to rectify it ( though why didn't you notice it straight away ? ). But a clutch is a wear-and-tear item - if it's genuine wear and tear then I'm afraid you'll need to foot the bill.
As I say, it depends entirely on what the fault is as to who's responsible.0 -
Age, price, apparent condition?
Five weeks or so - when did you first notify the dealer, before or after 30 days from sale?0 -
When you say you've taken it to a garage, is that a different garage to where you bought it?
Are that garage currently dismantling your car to look at the clutch?0 -

It's a vaughall safia, 16000 miles on clock, we was not aware of any issue when we bought it, when we discovered the problem it was past the 30 day mark (35 days), thanks for the responses, it's just I do not know how to go about it0

have you notified the garage you purchased it from? As you should give them chance to sort/look at it. If you have taken to another garage they may be reluctant to pay for the repair. The clutch, mas already stated is a wear & tear item, such as tyres/brake pads etc.
I would ring the garage you bought it from, be polite and explain, you never know...debt free, savings in the bank0 -

You have up to 6 months to request a repai then refund if they refuse0 -
The thing will catch fire soon anyway0

Clutch is not likely to be covered under any warranty. It is possible, if one drives a car like a it's a track day, to destroy the clutch in weeks.0

I think your best bet is to get an expert opinion to determine if this was an existing problem, but this is never guaranteed. You could easily end up with both sides trying to argue blame.
At the very least, you did buy it from a dealership (rather than sold as seen via a previous owner) so you do have some rights but - as already pointed out - you're dealing with a 30-day limitation.0
