With Elliot and loake , don't they have to provide evidence that YOU were the driver if they wish to proceed? So I take it this is just letter tennis again...? If so i'll reply with my standard letter that I've sent them the last three times now. :-)

BWlegal will not or could not provide evidence, they prefer to work on a assumption which is big game of chance for them
You can continue this letter tennis if you wish by stating they are attempting to mislead you by using a criminal case which has no reference to you.
If I remember in that case DNA was used
If you keep getting this rubbish from BWLegal report them to the SRA and let them know you are doing so0 -
Elliot v Loake is being used as some sort of "catch all magic bullet" when POFA terms are not met.
I've got a two where that has been threatened, but the RK is a Limited corporate entity. I genuinely believe that they have not thought that through properly...<--- Nothing to see here - move along --->0 -
In this recent letter they repeated 4 TIMES that I had to reply/contact them within 7 days. 3 of those times were at the bottom of the letter in the same paragraph.. ie
Our client is amenable to resolving this matter within 7 days. We would be grateful if you could contact us within 7 days of this letter. We look forward to hearing from you in 7 days.
Is this usual in a legal letter?!!?

NOPE it's a BWLegal begging letter. Real solicitors do not behave in this manner, one must assume it has been written by a child0 -
