I am still without hot water but after threatening to get a heating engineer out and bill the landlady I had some convector heating dropped round to me.
I'm am supposed to be moving out by Friday from the property but is a month earlier than my contract as the landlady agreeded to refund me a months rent if I moved out a months earlier than my contract.
Now the letting agent is saying they won't refund my rent plus the landlady rang me tonight to say she wants to start ripping out the old heating system tomorrow, that it has to be tomorrow and if I'm not there then she will let them in anyway.
My questions are
1. Am I in my right to say no as I'm mid packing and moving house with a tiny baby and other children.
2. If they are doing all this work and the place ends up a mess how are are they going to do my check out inventory as there will be dust and crap everywhere.
3. Is it unreasonable for me to fight for that months rent back?
4. Do I have any rights in any of this as I stand to lose close to £2000 in rent and deposit if it's not sorted.
I'm so so stressed and I know I'm moving out but I just need to move out without building work going on at the same time.
I'm sorry if I'm being unreasonable, I may just be being highly strung as the stress is getting to me.

Just to add, I'm not trying to be awkward but I'm doing the landlady/ landlord a favour by moving out early as she said she was desperate for the house back due to a change in circs and now I feel like I'm being totally played, especially as I've not had hot water for 2 weeks and had no heating either for almost a week, plus the convector heaters are killing my electricity0

How was the early surrender agreed? In writing? How was the refund agreed? In writing?0

The early surrender was agreed verbally but followed up with a letter from the letting agent with notification that I will receive back any rent owed to me on a pro data basis.0

I'm so upset, I'm trying to pack and get it together but I'm not going to be here tomorrow morning as I'm collecting the keys for my new house and I can't cope with the landlady letting people in without me being there ( I have mental health issues, OCD being one of them :-( ).0

Then what's the issue regarding the rent refund? You have it confirmed in writing the tenancy will be ended early and you will receive a refund. If it's not forthcoming once you move out then it's letter before action and then small claims court. Simples.
As for letting the landlord in then just tell her to !!!! off and wait until you've moved out. Change the barrel of the lock (very easy, lots of videos on YouTube showing you how) to stop her gaining access.
Now do you have the right to do that? Well that depends on what your TA says about access for repairs and whether your LL has given 24 hours written notice that she wants to access the property. Even if you don't have the right what is she going to do? Evict you? No chance that she will get a court date over access or for an eviction notice before you move out.0 -
I don't see a problem. But for the avoidance of doubt, can you tell us exactly
* what was written in the letter (word for word)
* was it signed by the landlady?
* date?
