Consumer Rights Act - and discontinued item

Options
Hi

I bought a camera from Currys a few months ago (within the 6 month timescale) the pictures are mainly out of focus and blurry. The camera has been discontinued, we got the last 1 in the shop which had been the display model, paid full price for it. Have contacted Currys customer service requesting a replacement who have given me the number for the manufacturer to organise a repair. I don't want a repair I want the camera replaced. Am I within my rights to stick to the request for a replacement? Or since they're willing to offer a repair do I have to give them a chance to repair it? Also I know they should be doing the running to organise the repair. If I do have to go down this route should I insist that they organise the repair?
Thanks in advance.

If it is no longer being sold, then I'm not sure how Currys can magic one out of no where to replace yours.

Would a refund not be acceptable? If not, then pursue the repair.

No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)

As it's a few months old they are entitled to repair it, has the fault been there from the start or just developed? What type of camera is it? Point and shoot, advanced compact, bridge, compact system or DSLR?

You can get them to arrange the repair for you but you will have to take it to one of the stores and leave it with them, it is usually quicker if you cut out the middle man though and call the manufacturer yourself.

I'd prefer a refund but as it's not within 30 days I didn't think I was entitled to request one? Figured if I requested a replacement another couldn't source it I could get a refund as that's their 1 chance?

My understanding of the Consumer Rights Act was if it was within the 6 month period I could request either? Fault has been there since we started using it. Which was a few weeks after we received it. Think it would be classed as a point and shoot. Just a Nikon Coolpix.

You can state your preference to a repair, refund or replacement but the retailer is entitled to ignore this request if the option you choose either can't be done (eg, if there are no replacements available) or if the cost of your preference is disproportionate compared to one of the other remedies available.

In that case are you sure it's a fault and not just different to what you are used to? The easiest way to tell is to put it on full auto mode and when you are trying to focus on something press the shutter button only half way so until it focuses on the point you want and then fully press the button. If that works then the camera is probably not faulty and you just need to learn to use it. If that doesn't work then it probably is.
  • Wha make and model is it??

Not the S2900 is it?? I have issues with mine too - takes a while and patience to get a decent shot!

Thanks. Helps me get my argument straight if I know all the ins and outs

It's definitely a fault, have tried all sorts including your suggestion and still getting blurry pics. Other people have the same problem with it as well, someone took 150 plus pics on it and maybe 10 are not blurry. I'm wondering if maybe with it having been a display model if something has maybe been jarred with people playing with it.
