Car garage fitted aftermarket part against my request

The car is a 2007 Lotus Elise S2 (Toyota engine). I have had it for 3 years, so not from New. (and yes, I realise, Lots Of Trouble, Usually Serious springs to mind)
I have had it confirmed from a Lotus dealership that cross drilled discs came as standard on the car from New. I have found the parts list and it lists the cross drilled disc.
The plain brakes are currently fitted to the car which I am driving as it is my only way of getting to work (without significant inconvenience). When they forced me to pay, I tried to say I want them to fit the cross drilled disc (they couldn't fit the old part as it is too difficult to align worn pads and discs) but they insisted the part they had fitted was correct. They told me to go to Lotus to prove it is the wrong disc, which I did.
I do not want to pay another garage to fit the new discs until I have had it confirmed I will be getting a refund as this will leave me significantly out of pocket in the short term.
Hmmm, this is tricky, as by using the discs you are showing acceptance.
You need to act MUCH faster here.
1. Get written confirmation immediately that the wrong discs have been fitted.
2. Take this written confirmation back to the original garage, and give them 7 days to confirm if they will be fitting the correct discs as thry have fitted the wrong ones. Were the crossed ones more expensive? If so, you need to pay the extra.
3. In the meantime, get a couple of quotes to have the correct ones fitted elsewhere.
If the original garage refuses to replace, then you will then have to pay for the replacement yourself elsewhere and take them to court, obviously sending a letter before action stating this to the garage...Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')
No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)0 -
Pinkshoes, I told them I had confirmation from Lotus that it was the incorrect disc but they said they will only refund me the cost of the part, and only if I could prove it was dangerous. I.e. They refused to replace, hence I am following other routes to get the money back, which of course will take longer. From what this forum said, my first route is to go via the credit card company.0
