Just discovered car dealer lied about Cat D status

    Arcon5: of course, I can't prove what the salesman did or didn't say to me on the day. What I hope to be able to show is that it wasn't mentioned on the invoice, or the adverts, that the distance I travelled was because it was a rare spec, not because it was a bargain, and that the price I paid was in line with non-cat D prices. This is going to be a balance-of-probabilities call for the judge. All the tough questions I'm gettng here are, of course, really useful to me to help me understand what I have to show, so I'm grateful for them!

    Custardy - thanks. I'd found that 2013 guide - it might do but I'd feel more secure with 2014 prices. I hadn't thought to try Glass directly, though, so I'll do that now. Cheers.

    Edit: Glass's have said there is no way they will release figures to me. Why is the motor trade so bloody secretive about this?!

    How do you prove a negative? All OP could do is provide evidence that supports his statement that the seller did not mention anything about Cat D ... but there's no way OP can prove this.

    Submit a Letter Before Action, in writing, to the dealer now, highlighting your case and what you expect from them (either to buy the car back at a non-D trade in price of £___ based on _____, or to cover the difference between a cat D trade in of £____ and a non-D trade in of £____), giving them 14 days to respond.

    You may find they'll just pay up to prevent it going to court (it may be cheaper for them), and if not you've already started the process formally.

    At this stage, it's all just bluster.
