DRP (Debt Recovery Plus) - ParkingEye

Options
Hello all,

I received today a letter from DRP (debt recovery pluys ltd) saying that i must pay my fine of 145 quid by 8/11/16 or they will pass my file to their client with a recommendation that they take court action against me.

all that fuss is about me not buying parking ticket in Crown Wharf Shopping Park, Walsall (i've had no idea you must pay there, been there 3 times never got actions agains me)

the creditor is ParkingEye LTD...... my question to you good people is, should i just pay the fine or ignore it and take my chances in court? Just to mention i appealed already and got turned down.

thanks for any kind of advice/help!

    It is not a fine.
It appears that you have not the Sticky thread for NEWBIES that explains how to deal with private parking tickets, and why it is safe to ignore debt collectors.
Nobody here will suggest you pay this.

If you appealed to Parking Lie, did you get a PoPLA code?

P.S I don't like to cave but i don't want to end up with 500 quid court charges either =/

Where did you make up that one from?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

What makes you think that is even possible?! Wow you have made that up!! Even if PE took you to small claims you'd pay about £50 over the PCN sum if you lost, that's all. Small claims track i disallows huge costs and there would be no effect on your credit rating either (even if you lost, if you then paid). But you are not there yet.

Why did you not appeal and send PE your receipt or bank statement to prove patronage & get it cancelled earlier?

So...in the NEWBIES thread the first thing I encourage is to complain to the landowner/managing agent and I give a link to 'Successful Complaints' a dedicated thread which includes successes by writing a polite email to Jonathan Jessop or Nick 'whatsisname' at Savills who run the place:

Email addies there in that thread.

Jonathan cancelled one I wrote to him about once and said he is surprised people do not notice the huge sign at the entrance which tells people to pay and display. Well it does, but it doesn't give any information about a contract or parking charge so you can't be 'bound to have seen' and agreed to a charge of £100! And I believe there are a lack of signs in some places (e.g. people seem to get caught out by a restaurant and never see any sign there).

I'd be surprised if you haven't complained to the retail park yet (as you would, why would people NOT complain about this harassment straight away?) but if not then get on to it politely and I think Savills will cancel, as a one-off.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
