Search query S106

Hi all,

I've received my contract and pre-contract report from the solicitor.

One of the points raised relates to Planning Obligations and S106. They have asked for the vendor to confirm that these have been complied with. The response received is that the age of the documentation os old and the seller refuses to obtain new copies. To get these it'll cost me £113 from the local council.

Now, the development was erected in 1996, if there were issues with the planning, surely they can no longer be enforced?

I know the usual response is to say "pay for peace of mind". But it's starting to add up. £80 (+VAT) for each for various certificates etc...

So close yet I now seem to be hemorrhaging money from all pockets at the moment!

    i think you'll be ok and that any obligation that the original developer was required to pay has now been fulfilled or its too late for the council to enforce it now. you might be able to track down the original agreement via the council's planning register by looking up the original planning permission to see what the developer was being asked to contribute towards.
