PPI company admin charges ?

I had a cold call about a month ago from a PPI claims company.

I'd had these calls many times before, i always gave them short shrift but this time I listened to what they had to say.

They worked on a no-win-no-fee basis with no charges upfront but they would charge 25% plus VAT on a winning claim.

I told them I had had a number of credit cards and loans before 2009, when I paid them all off at the same time and I had no documentation whatsoever relating to them.

They said they could sort all that out for me

. Even though I said I always steadfastly refused PPI, which the card/loan companies always tried to sell to me. They said some of these companies often slipped PPI in without the customer knowing about it.

That was news to me and if true, it surely amounts to fraud.

Anyway, I couldn't be arsed to find out all of this for myself so I reasoned that if i got some money back. it would be money I wouldn't otherwise have had, even after their substantial cut taken out of it.

So i agreed they send me an engagement pack which I signed on every page and sent back to them.

That was about a month ago and this week I had a phone call from them and they sent me a letter of confirmation notice to sign and send back to them ( I haven't signed and sent it back yet).

It says they want my permission to pursue EGG ( now defunct ) for a claim on my behalf. I had a card for a while with them in 2004.

I now have my doubts about this claim and this company after reading some bad press about them but could they charge me a fee for their work so far ?

I can see nothing in their T&C's to this effect if I cancel but I'm not sure if they have the right to make a charge.

So you now have a legally-binding contract which you've signed.

If you now attempt to cancel at this advanced stage, then the Claims company will definitely charge a fee.

But if you are so certain you didn't have PPI, then simply progress with the "complaint" and you won't be charged unless you win.

Using the same free of charge process you could do (typically writing to the bank with proof they represent you and asking them)

A well known CMC lie to hook you in. PPI is included on every credit card statement where you have a balance as a separate charge, the only way you'd not know would be if you never read your statements

Yes it is, as is most of the stuff CMCs tell you

You'll still do most of the work for them, they just post an envelope off with a letter full of lies

Yes they will charge you an expensive exit fee especially if they know you had PPI

But like I said, there is no such fee mentioned in their T&C's for cancellation.

It'll have been on the stuff you signed if not the Ts & Cs on the web

Worst case ring up and ask them

    Yes but

And section 2 of the Fraud Act 2006 says:

    2 Fraud by false representation
    (1) A person is in breach of this section if he—
    (a) dishonestly makes a false representation, and
    (b) intends, by making the representation—

    (2) A representation is false if—
    (a) it is untrue or misleading, and
    (b) the person making it knows that it is, or might be, untrue or misleading."

In theory it might be possible to add PPI to a loan without you knowing but with a credit card it is not because the premium would be detailed on every statement.

As the CMC holds itself out as expert in these matters, it seems unlikely that it would not know about this - unless of course it was being dishonest when it claimed to know.

However, if they are correct and you signed up to a contract with the lender/insurer without first ensuring you knew what you were letting yourself in for, you have just done it again with the CMC.

This is beginning to look like a habit - which you would do well to break.
