Recurring contract re-enforcment

I will make this as brief as possible...

Last october I paid around €70 euros to create qr codes for my business: qr-code-generator(dot)com I got the starter pack which meant I could have unlimited codes and 10,000 scans. My account was stopped at only 100 - for no reason at all! At the time I did not contact the company - instead I found another website to create qr codes for free as i needed them quickly.

Anyway a few weeks ago I get an invoice from them asking for another years payment. I did not realise it was re-occurring....anyway what I want to know is can they make me pay this bill?
The credit card I used last year has expired since then hence their invoice via email.

I do not want to pay for another year and for something im NOT going to use - bearing in my my account was stopped for no reason at 100 scans/codes for last year so I barely got any use from my account last year!

Their contract says they needed 30 days notice, but they MAKE me pay? Can they take me to court? I do believe they are not in the UK, but I dont want to pay.

Im hoping someone can shed some light on this?

  • Technically, you've got a Business To Business (B2B) transaction, and the protections are different from an individual person dealing with a business.

    This isn't an area I know about, but I think there are a few people on here that may know better, although MSE is more a consumer-oriented forum.

    If you don't get a response here, have you tried the UK Business Forums? They're pretty helpful over there.

    Technically you owe the money as you didn't cancel, the chances of them taking you to court however are slim. You will get a few letters but it wont go any further.


    P.s I thought they could charge an expired card if it's still an active account.

    If they set up a Continous Payment Authority they can still charge an expired card. I'm guessing they didn't set one up?
  • If the contract is auto-renewing and it requires you to pay, I suppose you may have to pay. As a business you don't get the same protection against unfair contract terms that a consumer gets.

    Why did they suspend your account? Read the T&Cs to see what they say about suspension. You could possibly claim that they acted in breach of contract and therefore you shouldn't be required to pay.

    If a debt is owing, they could of course initiate a small court claim against you to make them pay. Realistically, if they are based overseas it would not be worth their while doing this if it is only a small debt.
