Pre Completion Flood

Hi all,
We've bought a ground floor flat and exchanged contracts (although only the wife signed and we didn't actually receive a contract) and paid a deposit.
3 days before completion I went back round with the estate agent to measure a few things and found the kitchen and living room under an inch of water. The boiler was leaking in the kitchen.
I shut the water supply off.
The flat is part of a larger building with many flats whose buildings insurance is part of the monthly management fees.
As we never received the management pack (the property was bought under auction conditions, however we never actually went to the auction, we just made an offer the day after it failed to sell) we have no way of knowing if the vendor was up to date with her fees.

Who is responsible to pay for the repairs required?
Any help appreciated.

    Responsibility for the repair to the boiler is what you need to sort out - that's probably down to you, but worth checking. The damage it caused is consequential and should be covered by the buildings insurance so talk to the management company about making a claim.

    I've spoken briefly to our solicitor as it was late on. We are awaiting to see what the agent comes back with. It seems obvious that the agent hasn't followed correct procedure, but I would expect that as our membership of the management company doesn't come in to force until we complete, I'm guessing the vendor would need to make the claim as they will be the one paying for the policy via their fees.
    BTW, just getting peoples opinions.....Naturally I'll follow my solicitors advice.
