Chargeback From Lloyds Debit card Desperate help needed

I recently used the debit card chargeback scheme through lloyds, It took a month or so and i sent all the relevent paper work and they accepted that i should get a refund and they did so give me it, Over a month later they write to me to say they are taking the money back the whole £645 which of course i no longer have!

I had some work done at a garage on my van and to cut a long story short they over charged me, and caused exstensive damage resulting in the same problem going wrong another 2-3 times after initially going to them. I sent over all invoices of the same work having to be done from other garages and they accepted i was right and gave me the refund.

I cant see how they can now take the money back after all the leg work i did answering al there requests getting all the right info over and they just say they are taking it back & sent a letter the garage sent back (Obviously they are going to fight there corner and lie there a garage) But should this not have been done before agreeing and sending me the refund not after??

I had my tax credits paid into the account this took all of this , ATM i have opened another account for future payments etc and because i actually hate lloyds with a passion and refuse to let them try and get this money back as they have left me overdrawn with charges ect and without money for my children i feel cheated.

Any advice welcomed thanks

    It is difficult to comment on the details of the claim without the full history. However, assuming you have a strong case you can always take the garage to court to claim your money.

    Also, it's no good blaming Lloyds. They are not the villains here. Your argument is with the garage. The garage were bound to fight their corner and you cannot rely on a chargeback to be the end of it - as it often isn't. Even if they did not challenge the chargeback it is likely that the garage would have attempted to collect their money via other means. The funds should have been kept available until you were sure that the issue was closed and that there would be no further comeback.

    This is nothing to do with lloyds and they are not responsible for someones shoddy work.

    Take the garage to the small claims court for everything that has happened and the cost incurred.

    It's incredibly easy to do I've done it with several companies who thought they knew Best.

    Fill out the forms of what you are claiming and why, supply the proof, get your day in court. it's such a fantastic experience to get to stand in front of a county court judge and tell him your side of the story. From what you have said you have a very strong case AND proof that the work had to be be redone 2-3 times.

    Send a copy of the court summons to the Garage to give them the opportunity to refund you prior to going to court, this usually does the trick and shows them you mean business.

    The bank are not liable as you have not claimed under Section 75. You should be using the small claims process against the garage, not chargeback.
