Some folk stop paper statements in favour of online statements
Regardless, "forgetting" to check one monthly statement may well be understandable, but neglecting to check twelve statements is just negligent.
It matters little what the OP should have done with regard checking his statements though, he should have made sure his cancellation was received and actioned. A year on, this looks more like "buyer remorse" because he hasn't actually been attending the gym and simply wants his money back.
Gyms rely on the inertia of members who don't regularly attend yet continue to pay.
The Bank certainly can't act on a copy of a cancellation letter which may (or may not) have been sent to a third party. The gym say no cancellation was ever received. Both of these facts put the Op in a very weak position.0
