Forced to resign

Hi All
I am being forced to resign from my 11 years with employer as they fail to make adjustments recommended by the Occ Health Doctor. Unison are not helpfull what so ever....well the head office are good but keep referring me to my regional office which are not at all helpfull to the point were I feel that they support the employer and not the emplyloyee. Can any one help? Please. :mad:

    Without knowing more details - no!

    But you cannot be forced to resign. That is a decision that you make, so don't do it.

    As you have noted, occupational health only make recommendations - that does not mean that an employer must make the adjustments.

    A union is there to support an employee - but that does not mean that they can (a) get what the employee wants or (b) that what the employee wants is reasonable. So it depends on what your definition of "helpful" is, and whether that is something the employer will allow. A union cannot force an employer to do something if the employer refuses. But it's impossible to comment further than that on this information.

    Beyond that, I am afraid that if you want help you must tell us the story.

    There have been several similar threads over the last few weeks and each time I have pointed out that "reasonable adjustments", in the eyes of the law, do not go anything like as far as many people fondly imagine.

    OH have said what adjustments are medically needed. It is not for them to say whether they are "reasonable" or not. Ultimately, if the employer refuses, only an employment tribunal can decide if the employer has done what is reasonable.

    As Sangie says, without a great deal more information it is impossible to say much else.

    Perhaps the OP is considering resigning, then pursuing a claim for constructive dismissal??

    In which case they need to get some good advice, heed it and think very hard indeed as only a tiny percentage of such claims succeed.

  • Well it's a long tale. I was diagnosed with fibromyalgia and CFS 6years ago and my consultant stated in his opinion it was protracted stress work related. However more recently i was being bullied at work 3years ago. I advised management however theu told me to take time off amd distance myself from tgis person which i did. When i return to work i found myself nit only being bullied by this person but also being mobbes by other members of staff including management therefore again i informed management and accessed employers EAP counselling to assist with the feelings of anxiouness and isolation. Then to be as brief as possible I was assualted for no good reason other than the person did not like me this person was a colleague, who happened to be best buddies with management. Management were trying to sweep this under the carpet however I ensured that HR were aware by providing a statement and insisting that they dealt with the matter via disaplinary procedure. Management were not supportive they expected me to continue to work alongside this colleague who had just assualted me, which i refused to do.....they left her working from our office location and move me as if I was the problem. The colleague was after a 7 month investigation disaplined. I then raised a grievance asking for the employer to acknowledge I had been assaulted, not supported and requested training for staff...i attended a grievance meeting where i disclosed confidentiality issues with management and staff, an agency temp worker also being assualted and further threatened by same colleague the previous year, managers recieved a written complaint from a member of the community 2 weeks before i was assualted regarding the aggressive and abusive behaviour again of the same colleague all the encouraged disclosures lead on to further investigations and wistleblowing to HR regarding management breaching confidentiality on social media which took another 7 months the outcome was nothing was substaciated however there were recommendations made. Begote the 8 month ordeal i suffered a stress breakdown and had to take 2 months off work to recover. Im my return I was located in a different base on my request as I didn't feel it appropriate to return to work under management I had complained about. I returned again no support from management little to no supeevision and then BANG😨 I was informed by another colleague that a folder which was created by my previous manager was found on the IT system named !!!! covering for all to read in this folder was information regarding me, my health, a personal disclosure regarding my physical and mental health, informAtion regarding investigations and an accusation about me from another manager which I was unaware of and it is untrue in any case. I raised a concern with HR using ICO template however after submitting this concern I was told my role was no longer required...and of course they can prove it's a business decision, funny that! Then I've been told that I had to work under my previous bullying manager in a side step role. I signed sick been to Occ Health who recommends that i am redeployed in another location under a different management structure.....

  • Thanks for the honest reply bu:eek:t why am i being managed out? I have been a excellent emplyer for 11 years with no complaints.....why do employers not support in my case? Really don't understand what I have done so wrong......what standing up for one's self?
