Horizon Parking Ticket

Please I am in trouble and believe you honourable and intelligent people here the likes of Coupon-Mad etc can help me.i have received a parking ticket from Horizon, for parking in a retail store in Bristol, the vehicle was registered in my wife’s name and but bad enough she has provided my name as the driver.Now today I have received the notice from Horizon ParkingI just received a the the notice from Horizon Parking now stating that though I have been named to be the driver but if I am not the driver I should provide the drivers details. Another issue is the fact that there is a camera that takes the picture when you enter the site and when you leave the site Please do I have any strong defence? Can I still deny that I am not the driver while I might acknowledge that I am a spouse of the keeper but my spouse erred by thinking I was the driver. Also will the camera not show my face driving? Please kindly help me? Should I just hold the ticket as I think I still have 28days to reply OR I should just acknowledge I am the driver or deny it entirely please help. Please I can provide the scanned letters I received from Horizon Parking. Please help. Kayola

    First of all complain to the retail store Manager and tell him/her how this has made you both scared and feel you are 'in trouble' - show the Manager the PCN and ask them to cancel it. Do not ask another employee, must be the Manager.

    Do not lie about driving.

    Secondly, just send the appeal in blue writing that's in the NEWBIES thread, removing the bit that says they must rely on the POFA and removing the bit that says the driver will not be admitted.

    The "camera" is not interested in your face, and they don't know you anyway it's ANPR which finds and logs your VRN but you should not lie anyway as CM stated.

    What exactly have they charged you for?

    I was in the store, the Manager was not ready to help. I dont what to do now?Do anybody know whether Horizon Parking has taken people to court in the past most especially on private land.?What should i do now.Has people ever won cases in which the driver has been identified?

    Yes Horizon try the 'odd' claim - not many - and they are certainly ODD because they use Gladstones whose cases are worse than hopeless!

    Yes, all the time. It just makes it harder to argue at POPLA but not a big deal. Don't make a mountain out of a molehill, this is nothing to worry about and you are merely at appeal stage and you have a template to adapt & submit so it could not be easier at this stage to get a POPLA code, then we'll talk about POPLA.

    Was this in a Tesco car park ?

    There is no CCTV involved here. If you got the ticket in the post, then its ANPR which only focuses on number plates.
    If it was a ticket on the car, then what did the warden do, run around like a headless chicken to get a face pic ?

    I appreciate all your kind help and assistance

    I am not sure whether to send my appeal this night based on 28days rule as the letter i received was dated 22nd of october from horizon parking, I have taken to advice of Coupon-Mad use template provided and remove bit about driver. I have also not heard from Horizon Parking whether with reminder since i received the first letter.

    Is it ok for me to send it now? or should i wait for some time and is i have to wait till when?

    I understand it is to get popla code.

    Please kindly help me and reply to my question.What should do next?

    Yes Kayola, do appeal now as driver (as you have been named already). If this was a retail car park, if you have receipts then attach them to the email because Horizon do cancel some for genuine customers. I think you can email a Horizon appeal (check the PCN for details).

    Coupon-Mad and Honourable People:please i am at the popla stage now, below is the reply from horizon parking:

    Thank you for your correspondence regarding the above Parking Charge Notice.

    I can confirm the Parking Charge Notice was issued correctly and legally in accordance with the British Parking Associations (BPA) Code of Practice.

    This particular car park is operated by automated number plate recognition (ANPR) cameras. The ANPR cameras capture an image of vehicles entering and exiting the car park and calculates their length of stay.

    Your vehicle entered the car park on 21/09/2016 at 07:49 and exited at 12:33 which is a total stay duration of 4 hours and 44 minutes. The maximum period allowed at this particular car park is 4 hours.

    Signage throughout the car park is compliant with the BPA rules and regulations. The signage is quite clear in its intent and is located throughout the car park. When parking on private land it is the driver’s responsibility to ensure they adhere to the terms and conditions of the car park.

    In accordance with the British Parking Association’s code of practice the amount of the parking charge notice is within what is deemed reasonable.

    Please also refer to the landmark decision made by the Supreme Court in ParkingEye vs Beavis [2015]. The Supreme Court ruled that the charge appealed did not contravene the penalty rule or the Unfair Terms in Consumer Contracts Regulations 1999 and was therefore enforceable.

    The charge in this case was ruled not to be a penalty as both ParkingEye and the landowners had a legitimate interest in charging motorists who breached parking restrictions, which extended beyond the recovery of any loss. The interest of the landowners was the provision and efficient management of parking. The interest of ParkingEye was in income from the charge, which met the running costs of a legitimate scheme plus a profit margin. The judgement confirms the charge was neither extravagant nor unconscionable, having regard to the practices around the United Kingdom and taking into account the use of the particular car park and the clear wording of the signs.

    In light of this, your representations have been carefully considered and rejected and the outstanding balance remains payable at £70.00.

    Please be advised £1.50 handling charge will be applied to debit and credit card payments.

    Alternatively, payment can be made via cheque made payable to Horizon Parking Ltd and posted to Horizon Parking Ltd, Waterhouse Business Centre, Cromar Way, Chelmsford, Essex, CM1 2QE.

    You have now reached the end of our appeals procedure. Although we have now rejected your appeal, you may appeal to Parking On Private Land Appeals (POPLA), an independent appeals service within 28 days of the date of this correspondence. To appeal to POPLA, please go to their and follow the instructions. If you would rather deal with this matter by post, please contact our Appeals Office and we will send you the necessary paperwork.

    Please be advised that if you opt for independent arbitration of your case you will be requested to pay the charge at the full amount and will no longer qualify for payment at the reduced rate.

    By law we are also required to inform you that Ombudsman Services provides an alternative dispute resolution service that would be competent to deal with your appeal. However, we have not chosen to participate in their alternative dispute resolution service. As such should you wish to appeal then you must do so to POPLA as explained above.
