Hello there,
We have recently received a letter from Parking Eye advising that we need to pay £100 for overstaying parking in Newquay at the start of September.
I tried researching this and ran through some of the advice given on the forum. I tried to start a new thread then but was unable to. As a result I appealed anyway. Eventually the appeal was refused and I now have a POPLA reference to appeal further.
The trip to Newquay was a stop on the way to our destination further into Cornwall. We stopped in the Tower Road car park then went for some food and some shopping. On return to the car, within the time showing on the ticketm we re-arranged the baggage and put the shopping away, then headed off.
Apparently we spent 2hrs 13mins in the car park and paid for 2hrs. We still have the ticket and based on the camera time, we took 5mins 8 seconds to find a space and purchase the ticket, not unreasonable. We then are photographed leaving 8mins and 3 seconds after the end of the parking time on the ticket.
None of this seems very fair, I'm sure there is nothing saying that charges would run from the time we pass through the gates, It also seems crazy that if we were, then there should be no time on the ticket and is extremely misleading. Anyway, as I looked into this it seems that the BPA require a minimum of 10minutes grace period at the end of parking, which we were well within.
Are you able to help with the POPLA appeal?

Searches are your answer. A quick search for the words 'Grace Period Tower Road' finds you this one I wrote the other day :

You just need to change minor details like 'the driver paid for 4 hours parking' and 'It is clear that the driver left and drove onto the public highway at the exit, just nine minutes after the time shown on the pay & display ticket.'
And can you tell us please, did you imply who was driving in your appeal or did you act carefully, choose 'registered keeper' on the drop-down menu when appealing and say 'we' did this...rather than 'I parked'.
And - so we are sure which of PE's two versions of PCN you got, does your original PCN (NOT the reminder, if you were sent one) have a blank space at the bottom, EXACTLY like this example:

Or does it have an extra paragraph in the middle of that blurb, about the POFA/keeper liability after 29 days?

Read the NEWBIES thread, it explains the deadlines, the POFA and gives a template appeal for keepers. That's why it is near the top of the forum permanently stuck there like a notice and says 'PLEASE READ THESE FAQS FIRST'.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
