Parking awareness services, Blackpool

Hi, on the 22nd October I received a letter from parking awareness services say that I wasn't parked in the confines of a marked bay on the 15th October, I was parked between the line but my car was over hanging the rear of the space due to the length of my car or the shortness of their spaces. I say this because I don't have any problems parking any were else. I have emailed their enquiry email department requesting photo proof of this? The letter also states is I don't pay within 28 days they have the right to recover the debt from my address. Should I just pay the fine, Iv looked on other websites and they have said ignore them but I'm worried they might come to my home while I'm at work etc so would appreciate any advice thank you.

    What are these other website you talk about in relation to ignoring?
    they are wrong.
    What did you say when you contacted the parking company? did you reveal the drivers name or any other details?
    Where was this car park, and whose car park was it?

    The car park was in Blackpool, Back Reads Rd, iv contacted Blackpool council and it is a private car park, she said she couldn't give me information to wether the car park had sufficient planning permission and for what times it can operate. The other websites I looked on were " legalbeagles" "pepipoo" and " moneysavingexpert"

    None of which tell you to ignore PPCs completely and have not done so for well over three YEARS. However, maybe you mean that we say ignore NOW - after you've appealed - and that IS correct advice. You appealed and you did not give away the driver - GOOD!

    As long as that email gave them the PCN number, your full name and address as keeper, etc.? Surely not just a name and email addy...?

    As long as you have appealed and given the details you needed to (NOT the driver's ID, but yes, the PCN number and name and postal address of the keeper) then ignore from now on.

    What on earth makes you think people will come knocking?! They can't send people out, or employ bailiffs you know! It's just an invoice and they would have to beat you in court first, then if you REFUSED to pay what the Judge said if you lost, only then could a 'debt' be enforced.

    Think about it - that series of events is not going to happen is it?

    No, it is not a fine and you can ignore debt collector letters which will be the stage that follows this fruitless appeal when you get a rejection email/letter:

  • They have just replied to my email, I didn't actually appeal I emailed there enquiries email address. Should I wait a week or so and then fill out their appeal form. This is what they have sent:

    Parking Awareness Services I have viewed the photos 2 do show my car hanging over the rear of the space, 1 is of their sign in the car park and the other is of the rear of my vehicle, there is no photos to show my car is up to the wall were there is a tree growing out of it. What show I do next. I am worried about debt collectors as im young and have just taken a mortgage out and don't want court fees etc
  • As already advised by Coupon-Mad (who knows what she's on about) no-one will come to your house. Here's what will actually happen next:

    1. You'll send in an appeal using the template in the NEWBIES thread - you need the IPC version.
    2. They will reject your appeal.
    3. You could at that stage appeal to IAS but there is no point
    4. Spend next 6 years ignoring debt collection letters (other than to write and tell them if you move house)

    There is a possibility that at some point in next 6 years they will send actual court papers. If that happens, come back here for further advice.

    They can only send people round if you go to court and lose. They can only give you a CCJ and damage your credit rating if you go to court, lose the case, and then still fail to pay them.

    Will you please calm down and read what's been said and the links given already.

    - your mortgage is unaffected

    - your credit rating is unaffected

    - no-one will come knocking

    - you will get some daft letters, so what? Just make sure you see them all & check they are not court papers (very rare).

    - come back if you get court papers, it is defendable and costs nothing if you win and about £50 in court fees if you lost in the end - big deal?! And we win LOTS of cases.

    You are correct in how this works, however due to constant misunderstandings of the English language, the OP and others new to this, need to fully understand.

    The Parking company appear to have said
    "The letter also states is I don't pay within 28 days they have the right to recover the debt from my address."

    If Parking Awareness Services actually said this they are complete idiots as THEY cannot use any means whatsoever to enforce what they call a debt apart from going to a County Court.
    This alone will give the wrong impression and starts to scare people.
    Parking Awareness Services are only a money making scam
    It's even worse that they subscribe to the Gladstones boys known as the IPC / IAS ... THAT'S ANOTHER SHAM STORY to which you can search on here and the net.

    So, if it does go to court, who knows, but as said above, Parking Awareness Services are complete idiots.

    Suppose you lose in County Court, you need to understand, a county court is a low court, infact the lowest you can get.
    It's a room, you all sit around a table and the judge will listen to both sides and make a decision.
    If you win, you can ask the court for your costs.
    If you lose, then you get up to 28 days to pay.
    If you don't pay, then you get a CCJ

    That will then cause a problem with your credit status but you are then able to add a note to your credit file to explain that you were scammed by a private parking company.

    The very worst scenario is that you lose, you do not pay under the instruction of the court ?
    Parking Awareness Services could spend more money to instruct a court bailiff to recover the debt.
    County Court bailiffs are nothing like the TV stuff, Can't pay we'll take it away".

    All this will cost money for the PPC and unless their stupidity is very vindictive, you will hear no more, simply not worth it.

    Bottom line is ..... if the PPC is a member of the IPC/IAS, they are scammers, Parking Awareness Services is one
  • Iv just looked at the PCN again and This is the paragraph they have used. "You are warned that, if after 28 days from the date above the parking charge has not been paid in full, or the name and current address of the driver supplied, we have the right to recover any unpaid amount of the parking change from you. This warning is given under schedule 4 of the Protection of freedom act 2012 and is subject to compliance with the applicable conditions under schedule 4 of that act" I will appeal with the IPC version template and ignore any other letters apart from a court letter.

    OK so they have attempted to use some POFA wording. I doubt they have fully complied, nor made sure that the terms on signage are adequate to communicate that you were 'agreeing' to pay them £100 for a minor overhang! In Council ticket terms this is known as 'de minimis' (overhang of a car over a line is a mere trifle that the law should not concern itself with).

    It would be very surprising if this PPC thought a mere 'overhanging a line' PCN issued by a 'chancer' of an employee is worthy of a court claim. Defendable and nowt to worry about.

    PLEASE DO NOT COME BACK JUST TO UPDATE US WITH BORING DEBT COLLECTOR LETTERS! WE'VE SEEN THEM ALL.

    , this is the same car park where P.A.S started the ball rolling in my case , exactly the same as this case . Please do not panic have a good look on this forum and pepipoo ,

    On pepipoo forum my case is there in full just search troubled newbie . Please don't panic and listen to the advice the good people on this site and pepipoo give .
