one more Q - I assume the vehicle is your own and registered to you at your normal home address?

(i.e. it's not a hire or lease vehicle)
  • It is my vehicle yes, registered to me at my home address where I received the NTK

I assume you live in England or Wales as well, as the laws are different in other parts of the UK, so the advice is different.
I married my cousin. I had to...
    I don't have a sister. :D

    One other small query

Hi there - I've received a notice to keeper through on the 14/10/2016 for an offence date on the 27/07/2016. Obviously this is the first thing I will bring up on appeal, there was no ticket on windscreen and the offence was captured through ANPR only.

The notice to keeper was issued on the 14/10/2016 for an alleged parking event dated 27/07/2016 which is outside of the 14 days after an alleged parking event maximum as stated on the Protection Of Freedom Act, Section 4, Paragraph 9 (5).

So was the NTK dated (issue date) the same date you received it?
  • I received this through the post on the 19/10/2016, the issue date written on it is the 14/10/2016. So this is well outside of the limit to send as set out in the POFA? Again, no windscreen ticket at the time, this is purely an ANPR generated charge.

Bottom line, so we are sure which of PE's two versions of PCN you got:

Does your original PCN (NOT the reminder, if you were sent one) have a blank space at the bottom, EXACTLY like this example:

Or does it have an extra paragraph in the middle of that blurb, about the POFA/keeper liability after 29 days?

    PLEASE CONFIRM WHICH.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • Mine is exactly the same as the linked document. It's not a reminder, it's the first piece of correspondence I've received from PE.

Hooray - you win at POPLA then, if you get this right at that stage with the longer POPLA wording we have set out in other threads about this sort of PE NTK! Winnable.

  • Nice! Well I fully expect them to refuse my appeal out of hand, it's in their interest I guess. So I may be back on at the POPLA appeal stage if you fantastic people could assist again? As of now my appeal has gone in as above
