I can do the aeration if I apply for planning permission. Sorry guys but if you edit your posts after I reply to them it gets a bit confusing ...Ive tried to cover the edits in the posts above0

Sometimes planning fees are waived if they are a result of a restriction the council has put on, and the change requested would be allowable under Permitted Development otherwise.
Yes I think your solicitor should have raised these but as I said the docs are old and thats probably why they didn't read them. However, what woud you like to be done? If you would not have bought the house if you'd known about ths then you might have some sort of case but I think realistically there's not a lot of difference that you didn't know earlier. How would it change things?0 -
Ok fair enough. If there weren't the restrictions I could do what I want as long as it complied with permitted development regulations...which would allow me to raise the chimney and convert the garage. The cost of a planning application is not huge, but having to pay to get architectural drawings of the elevations of the house to raise the chimney grinds a bit.0
