CCJ at old address despite having the new one.

I got into some debt some years ago and only about 6-7 months ago started paying it back. A lot of the debt is with Lowell.

I have been making regular monthly payments without fail. I moved in April but immediately updated them with my new address.

By chance I checked out my credit score this morning and found out that they took out a CCJ against me for £122 at old address on 16th September!!

Despite having had several different communications from them to my new address.

I know there's stuff in the news about future changes etc.

I am now going to potentially lose my job because of the sector I work in.

If I knew about it I would have paid it off within the 30 days that you are allowed.

I don't know what to do and the worst thing is it's a Sunday I am so stressed

    Hi,

    The only thing you can do now is to apply to the court for a set aside motion on the grounds that the creditor sent the claim form to the wrong address.

    This involves filling in court form no N244 and returning it to the issuing court, the down side is a £255.00 fee will apply.

    Now you can get help with the court fee if you are on a low income, otherwise you will have to bear the cost.

    If you are successful, and the court decides in your favor, you will return to square one again, and the CCJ will be removed from your file.
    However Lowell will be able to take you to court again, but if you admit the debt, and pay within the 30 days, another CCJ will not be recorded.
