Dangerous seems a bit strong. You may need to drive slowly if it is potholed, but everyone using it must be well aware of its condition. If a driver races along and causes an accident it is the driver who is dangerous - not the road.crummymummy72 wrote: ». It is getting very dangerous.0 -
I think the phrase you are after is "contributory negligence".
That being if someone hasn't taken reasonable precautions to protect their own health and property.
I believe it's the norm to lose up to 50% of compensation payable if there has been "contributory negligence" as a general principle.
That does still leave the Council (or their insurers at any rate) paying out at least 50% of any damages.0
