Help with parking CCJ

Hello, please accept my apologies if i am repeating anything on a previous thread, i am new to this and first time i have used this forum.

Please can someone help me!

On carrying out a random search of my experian i discovered i have a CCJ from new generation parking. to cut a long story short it was for a parking violation to an old address, so all of the court papers etc got sent to that address and the CCJ went on by default as i did not reply.

I am now in the process of applying to have the CCJ set aside ... and have read up on how to do this, and have form N244 infront of me.

Could someone on here please give me some advice as I need to provide evidence that i have a realistic prospect of a successful defence ... and reference a previous case where someone successfully challenged a private parking notice. I have searched the web and cant find anything, but if anyone on here could help me I would be so greatful! I need to get this CCJ taken off asap as i now cant even get a credit card or any sort of credit.

Getting a set aside for papers that were sent to the old address should be straightforward. But when you get in front of the judge he/she might want to go straight to a rehearing there and then.

So which car park and what was the issue e.g. overstaying, not paying etc

Surely the court form does not ask that, does it?

If you have Cardiff or Neath as your local court, they appear to know the score. Remember that you can fight this as the registered keeper, not saying who might have been driving (after all you know nothing the case, just found a CCJ). That is BETTER than fighting as the driver, because you can require NGPM to prove they complied with the POFA and they will not have done.

There is a template complaint letter linked in that thread, provided by the BMPA. USe or adapt it and tell Mrs May/Mr Corbyn, the DCLG and your local MP, what has happened. This is wrong, tell them how this made you feel and that it is a scandal that the Courts are allowing this to happen then charging victims £255 to overturn it, plus get their case heard when there was never any 'debt' and the charges are spurious ex-clamper dross.

A horrible situation which should be crushed by Government intervention asap.

Send a covering letter with copies of all these letters so they land with a thump on the desks at the DCLG, your MP and Mrs May's advisers.

There is also a Daily Mail journalist's email address in that thread, he wants stories about people credit clamped and threatened by ex-clampers into paying extortionate amounts. You fit that bill.

Even if you are not in that area, send an email to David Dunford at the DVLA who has corresponded with Derek Donovan (the chap who leads that Action Group) and the DVLA said this:

as he appears to be willing to look at CCJ's and is taking an interest in any 'predatory tactics used by NGPM' and says the DVLA will investigate...so tell him.

All i know about the parking notice is that it was for Talbot Green car park, i dont know anything else because i had moved house by the time everything was sent! the car park i know is notorious for sending notices to people who overstay an hour, so i am assuming that this is the reason ... but as i have never had any sight of paperwork i really dont know anything more!

When i have researched getting a CCJ set aside it tells me that i have to satisfy the court that
1. I have made the appliction promptly
2. I didnt receive the original county court claim forms
3. realistic propect of a successful defence

Thanks for all the info ... the parking notice was for a car park in talbot green but i moved to llanelli where i now live, so i think it will be heard in llanelli court?

i am so upset by this ... im a single (working) parent of five children who rely on me totally financially... now i cannot even get a credit card if an emergency was to happen with the car, boiler etc ... i desperately need this sorted out.

i cant believe they have done this to me .... my credit was perfect before this, i am so careful with money! its so frightening to think that this could effect me for the next six years, and i work in financial services so i could lose my job. so horrible.
