Advice re unexpected PPI refund

Hi guys

In 2014 my husband contacted the Claims Guys (mistake number 1 I know!!!) to investigate his PPI on loans with his bank. There were lots of forms which he filled in. We received a letter from the bank in 2015 rejecting the claim as the address given didn't match that on his bank account (he had forgotten to change from his parents to our new address). We were in the middle of moving house again, and have had various health issues to deal with since and he never updated the Claims Guys with new addrress details or filled in the last forms received. Basically he abandoned the claim process.
He did update the bank with our new address.
Fast forward to this week and we have received £5.5k PPI refund from the bank.
Should we assume that this is from the original
Claim instigated by the Claims Guys? Unfortunately I threw all the paperwork away as husband wasn't bothered with it anymore and with moving house there is no way to tell if the Claims Guy claim was shut down or whatever.
Would like to know any advice about finding out if we owe the Claims Guys without asking them outright (looking at reviews online they sound like a dodgy bunch so I wouldn't trust this way!)
Do banks automatically pay PPI back? Out of the loop with this. It was Barclays. Could Barclays tell us if it was via a third party?

    Just note that if the Bank have finally taken action on your original complaint, then they will be informing the Claims Company as you signed a legally-binding agreement that they would represent you.
    So I wouldn't be spending all the money just yet.

    Did the bank's offer letter make reference to your original complaint?

    Of course you can ask the Bank who instigated the complaint.
  • Thank you, I wondered if this was the case re them contacting the claims guys. We've not had an correspondence at all yet bar a text from the bank and the money. We haven't heard from claims guys since before we moved house and husband is reluctant to ring them. I think they have his mobile number but can't be sure.
    I have worries that if he doesn't contact them and they can't et hold of him as he hasn't updated address that they will issue a CCJ or similar. Unfortunately my husband did this all off his own back so I don't 100% know what was signed and he can't remember... I am trying to get him to contact the bank. If it were me I would have rung them straight away!!! But I am not on the account so can't do anything about it, just 'advise' my husband (which doesn't go down very well 😁)
  • You can set your mind at rest (or know for sure that you owe the Claims Company fee) by contacting the Bank.

    Certainly, when the company are made aware of your payout they will be chasing you for payment. They will use debt collection agencies and ultimately court if necessary.

    It says that the original PPI claim was rejected (this is the one by Claims Guys). But as part of ongoing commitment to serve customers they conduct additional reviews into complaints received and has been found he was missold.
    Goes on to say any third party involved we have to settle with directly.
    So still a bit grey really.... Does this mean they have contacted them or not?? Will press oh to contact bank and find out if they are writing to them.
    Is there any other way Claims Guys could find out PPI has been made? Other than us or the bank telling them?

    The very least you need to do is update the Claims company with your new address. Without asking them if you owe them money you could simply give them your husbands name , old and new address and the month/year that you had dealings with them. If you do owe them money Im sure they will soon come chasing you.

  • If the original complaint was rejected and the CMC did not take it to FOS then the contract between you and the CMC is likely to have ended six months after the rejection letter was sent.

    I suggest you ask the bank if you can have a copy of the rejection letter. It should say you have six months from the date it was sent to go to FOS. Once you have that, hang onto it. Then, if the CMC come after their cut you can complain.

    They may say they did not have your contact details but if you did not change your mobile number when you moved and they had that number, it is unlikely to be a persuasive arguement.
