Want to take house of market, they say in contract until 13/12/16?

Hey guys, house has been on market since 2nd September, looooafs of viewings but not one offer yet. Starting to wish we had remortgaged and just took additional borrowing on our current house. Asked remax if we could take it off the market and they said we are in contract until 13th December. I'm wondering if they won't let us take if off market prior to this, any time they book a keeping can I just decline? And keep declining so we have no more viewers? Hoping eventually they will realise no point keeping it on market if we do this and let us take it off earlier so we can apply for the remortgage but not sure if I have an obligation to allow viewings for as long as remax advertise it? Appreciate any help. Many Thanks

As you say, it's idiotic, just keep declining offers to view. Then nothing to stop you applying for a remortgage now.0

This doesn't make sense. Write to them telling them you no longer wish them to market the property.
If you were to decide to put it back on again then if it were before December then you'd still be in contract but if you do not wish to sell at all then they cannot make you!
What agent wants a house on their books which the seller does not want to sell? Totally pointless and a waste of their time and money marketing it.
They probably just want you to stay on in the hope that they might just get you an offer and it might still come together. An offer could always be just around the corner. But if you're going to refuse it there's no point getting it!0 -

Did the mortgage company say why this bothers them?
And how does the mortgage company define "on the market"?
If they really are concerned about the property being listed on Rightmove, explain to them (in writing, if necessary) that the property is not for sale - but you are in a contractual dispute with an EA who is refusing to remove it from Rightmove.0 -
The contract you have with them will prevent you using anybody else to market the property - or, if you do, oblige you to pay the first agent commission even if the other agent sells the property.
It is utterly pointless them continuing to "market" a property where the vendor has decided not to sell, because even if you do get viewers, you're just going to tell them "Sorry, the agent's wasted your time" - which is to the agent's detriment.0 -
