Moving House - Virgin contract "cancellation fee" (Unique situation)

You have been consuming their services and presumably paying for them from your bank account. I think it would be difficult to prove that there was no contract, regardless of the error.
They are not cancelling the service, you are. They have a contract to provide at your current address, not any address in the UK0 -
But surely from a purely legal point of view that contract is not with me (my name) whether or not I've been paying for it. I know it sounds stupid. Thank you for the reply anyway!0

It's ridiculous trying to worm your way out of a legally binding contract simply because of a spelling mistake. You have already agreed the contract simply by continuing to pay it. If you genuinely had a grievance, you should have insisted they correct the name at the outset not months later.But surely from a purely legal point of view that contract is not with me (my name) whether or not I've been paying for it.
You'll have to pay the Early Termination of Contract (ETC) fee I'm afraid.

When I took this out on the phone, they got my surname wrong and have refused to change it without me sending some sort of proof in which I didn't want to waste my time doing.
So actually, it is YOU that is refusing to get it changed, not Virgin.
And no doubt Virgin will have all the evidence of their requests for this information, your acknowledgement it is wrong, and your refusal to send it.
I doubt they will take you to court if you don't pay it. They will probably just sell on the debt to debt collectors, and trash your credit rating so you'd be wise to settle it.0 -

On another note, if I weren't settling it. Would that actually end up on my credit rating as its not under my name (out of interest) Guess they'd actually change my name then but would they without my permission!
I wouldn't want to affect it cause I think its roughly 650 out of 710 so not looking to do that! 0 -
